As far as fighting the city over pothole damage, you can certainly try, but here in Dallas at least it is virtually impossible. The exact pothole has to have been reported (in some cases YOU yourself have had to report it), and the city given adequate time to repair it and then be able to be proven negligent in the repair or lack thereof before they will take a claim. That's why I purchased wheel and tire warranty/insurance when I bought my car.
I think he could only claim these in insurance if they were under his policy as a mod, otherwise they have to be OEM wheels, I could be wrong anyone else ever attempt to claim wheels might want to chime in?

Also yes, if you have road hazard warranty they would replace the tires.
