pulled over for racing....not actual racing
got pulled over for doing about 120-125 on a 80 zone right before entering 407 in pickering, 2 am monday....was just me and a cop that came out of no where and tailgated me. I was pretty sure it was just going to be a speeding ticket, wasn't expecting him to say i was 50 over, racing....
Cop said he was pacing me at 170 km/h and ive never gone that fast in my life Anyway so they took my license and car for 7 days. I need a good lawyer/paralegal, prosecutor is seeking jail sentence. Whitby courts are harsh.... Any suggestions on what to do and where to seek good legal services?

You seem pretty calm about the whole thing based on your post... I don't have much details as I've never been through it and dont know any lawyers, but I do wish you the best and hope that you get away without any harsh and unreasonable penalties.
This is so stupid... you are treated like a criminal for driving down an empty road at an "accelerated pace"... |

I heard (if someone has more knowledge please clarify this) that pacing is not sufficient proof as it raises reasonable doubt in court, is this correct ?

The courts already proved that the racing law was unjust, a Grandma fought it and won.

In order for an officer to pace you, he has to follow you for a certain amount of time/distance before making any judgements. I don't recall the exact amount though. They are easier to contest as the officer has less concrete proof, particularly when it comes to showing calibration documentation for their speedometer.

This whole law is BS!!! Stupid Ontario!!! like seriously, speed is not a problem! Focus your time and energy on the ppl who cant drive, ppl who tailgate, ppl who talk on there phones, cant maintain speed, sit in the third lane doing 100kmh, ppl who dont drive according to the conditions, ppl who are just plain retarded, ppl who drink and drive. If they taught ppl how to drive properly in the first place and then enforced it all properly, Hey Guess What!!!! We could all drive fast then without incident, look Germany! This country is just stupid, all the government wants at the end of the day is your money. They dont care about our safety, just making money. Now I'm not saying speeding is safe, its not because ppl out there can't drive, and most that speed can't drive either. This country needs a proper driver education system, anddddd MANDATORY retesting!!!!! Anyways, rant over!
Sorry but I just hate the stupid laws in this country!!! I wish you the best of luck OP!!!! I hope you beat em and get money back for the towing and impound fee's!!!

my buddy got booked with this pretty much right the law was introduced a few years ago. He drove a civic back then and it was on the 401 close to gueloh where we went to uni. The cop said the SAME BS about pacing behind him and took away his car and license. While this was going down a guy in a BMW passed him and the cop decided to let him go while he was "pacing" behind my friend. This pacing garbage is ALL BS! He got a good lawyer and it got thrown out. he got a 10 over or something.
Pacing.....hahhaha! |

Your word against his. If you're lucky he won't show up and you'll be scotch free.
If not, ask for his notes and review them to see what evidence he is basing his decision on. A good paralegal will get it reduced to some BS speeding ticket. GL bro |

well even so, 125km you estimated, in an 80...so you probably did go more than 50kmh over speed limit anyhow...he has the right to take your car for 7days as part of the law....just obey the rules and you shouldn't get in this bad mess.. good luck
