Thanks a lot booyah.

Guys, this member could be a big help. He's on both sides of the fence, if you will. Also, in friggin Alaska, where by the time they confirm anything there, they should have it EVERYWHERE,

So, booyah, not trying to be an ass, but, being an SA...are you flat out saying you agree that 29.2+ sucks and makes the car slow and laggy unless you wring it out above 3500?

shaddai, in california you need both parties' consent. not only would it be inadmissible in court if you did it, it is actually illegal.

Just a stupid noob here but I would bet you will not see a lag fix until you see a wastegate rattle solution. I will bet anyone here $100 31.xxx does not fix the lag. RBBMWE46M3, great chance to take advantage of a noob here

Please understand that BMW employees are, of course, a bit restricted in what they can state in open forums. Nothing special about this, it's pretty much the same across the business world. When v.31 becomes available and what it includes are more likely to emerge out of our NJ members first anyway. But yeah, thanks to booyah for any helpful info!

The invoice also says car was updated to 31. SA and foreman said 31 does not include a DME update. I'm no expert...but the way I see it there are 2 possibilities:

1) DME is just one of the modules that can be updated with progman. 31 is a version that does NOT include a DME update (I think this is the case, see mistermojo's post above)...or...

2) SA's notes on my invoice about my car being updated to 31 are b/s and my car was NOT updated to 31, but rather to 30.2 or whatever
I see a third scenario.
In Europe V31 includes DME update (It clearly says DME reprogramed on my workorder/final report) but It is not included in the U.S "version" on V31.
However I very much doubt that you got V31 as it is not a the term used in workorders, you workorder should have said: E89X-08-09-515. Whoever wrote your workorder did It asuming the latest s/w availible to him was 31. Bet a million buck It was never double checked to make sure. You got 30.+

the fact that there is anything other than "S/W update installed" written on your invoice means that your SA is either an idiot or he/she just wanted to make you go away believing that your car was updated w/v31, therefore, taking you for an idiot.

shameless !

How would BMW ever find out if an employee was on here posting. He or she could be as invisible as they wanted.

I think Bottom line is. USA DOESNT HAVE v31.

So we all need to wait in USA until someone confirms its HERE in USA.

If the v31 fixes the lag in Europe im sure it will in USA.

Call your dealer and ask. They might be able to tell you.

Yeah, I think you may be right. I think my SA neglected to check the version. But, that doesnt explain why my invoice doesnt show the update number. Or, they didnt update me at all, or they updated me to 30.2. I could tell my car still sucked as soon as I started it from the exhaust sound. Those bastards. I'll call him on Monday and find out WTF.

Anyway, sorry for any false alarm guys.

Two parties consent is defined at:

http://www.fcc.gov/cgb/consumerfacts/recordcalls.html

I've phoned up several places that have the beep tone. Gets surprisingly easy to ignore the beep after a while.

BMW updated their website. You can now explore the 2009 sedan:

http://www.bmwusa.com/Standard/Conte...rformance/335i

They changed the words they use while talking about turbo lag. See attachments for screenshots as they use Flash now...

The link to the old document still works, but it looks like they're trying to change their story.

Wow...sonsofabeeches. Sneaky ones those bavarians. Good thing we aren't the morons they take us for and we've already saved and documented their claims of the car at the time we wrote those fifty thousand dollar checks.
I just need enough compensation from this suit to make up the difference on my 07 335 to an 09 c63, plus the 551 hp $2200 rentech stage 1 ecu. No turbos there for MB to bait and switch people with!

WOW, thats wild. They actually changed the way they are presenting it. I do beleive this could be interpeted as a passive acknowledgement that they realize there is lag.
I still have the brochure for my 2007 complete with dyno chart that BMW used and the elimnated lag statement.
The BMW site still shows the eliminated lag statement for the 335i Coupe.

Sure looks like passive acknowledgement. However, I found the old document in the same place it was at before, even in the 09 sedan. The physical brochure I have uses different words: "Turbo lag is a thing of the past". Slightly less definitive than their bold claims on the website that has been quoted way too much in this thread, but still a far cry from what we have been delivered.

i agree with this (pure speculation). when you ask your dealer, the question shouldn't be did i get "v31" the question should be, did I get E89X-08-09-515 - this is the engine software #. v31 is just a group of software for various modules in the car.

I have a Audi S3 and I can launch it at 6000RPM! The car would rocket out from the start
So if you don’t have a LSD, don’t bother trying. From a roll, you should kill a S5 anytime!
Fact is that we started at a red light and we both have automatics. Both were in sports mode (1st gear confirmed by pressing gear down). My tires didn't even spin nor did the antispin system light up. Basically the car feels slow until around 2500rpms... Is this how Dinan S2 is supposed to be?

I can tell ya that we have nobody ever come in and complain about any turbo lag yet? As far as mine It does seem a little soft at the bottom but really I hardly get to drive it because Its the Wifes car and that car is gold to her...lol she has been wanting a BMW for like 5 years and I finally got her one and she wont let go of it!
