Correct. It's simply there to meet a certain California Emissions standard. The E90 meets the LEV II ULEV standard at this time. Check out this link - very interesting: http://www.driveclean.ca.gov/en/gv/d...an/bguides.asp
Most all manufaturers now ship one emissions spec for all US, CA emissions, rather than a Fed spec and a CA spec as was the case a few years ago. It's simply cheaper this way, obviously. Edit: By the way, the very first thing I'm doing once I park my E90 in my garage, after taking delivery of it later this month, is remove that darn thing. It's been about a month since I removed mine and here's my report.
What happenned: 1) better from a stop acceleration 2) better sustained pull through the powerband What hasn't happened 1) constant smell of vapors in my garage. 2) decreased mpg 3) EPA, BMW, State of Ca. et.al knocking on my door because a sensor went off that I removed it. 4) Birds, planes, etc failing from the sky because of the increased vapors. 5) All my tress are dying from the smell. Am I being an ass, yep. But guess what folks, I'm the one who spent 40K+ plus on this car and it's MY filter to remove. If you don't want remove yours that's fine too, but it's time to start showing some for anyone who has the right to handle their asset in the manner they choose. I removed mine last night and forgot to plug in the Air Mass Flow sensor, so the idiot light (yes for me - duh!) came on (Service Engine Soon). I plugged the sensor back in and found OK results with maybe some better response from the engine. I took the car to the dealer today and did not say anything excet the light is on. The report I got from the dealer is that the sensor is reading a lean mixture (because of the less restriction no doubt) and he wants to replace the sensor, but must order this part. He did reset the light and it has not gone off - yet. I will likely not go back for the new sensor when he calls unless the light goes on again. I am wondering if the lean indication will be compensated for, or will this cause an issue down the road. One other issue is that, if they replace the good sensor will the reading still be lean, causing the technition to further trouble shoot the "problem" and find my "Free Power Mod". Has anyone else had any issues with the "Service Engine Soon" light or know if the computer is reacting properly to the lean mixture indication?

Anyway your problem was it read lean when it was unplugged and that was the error stored in the DME not the current condition the OBDII only stores errors that make the CEL come on and not a status of constant monitoring. If the error does not repeat the CEL will go off. There are others that have done this mod and no CEL so it may just be isolated because of the disconnected MAF. I would not take it back to the dealer to further investigate, especially if the CEL does not come back on. Keep us posted.
