You'll most likely have to reinstall the stock downpipes and stock airbox to pass the visual inspection. You can try installing the BMS DP fix and follow the write-up to set readiness, but California is pretty strict on emissions.

you have to do your downpipes for sure - you need those cats. They don't care about "sound" but they do care what you're emission reading are and those cats will be the only thing to keep those reading down. You will fail without them. As for your intake, as long as you have the sticker showing it is carb legal, you will be fine.

by any chance do you know if bms dci intakes are carb legal. I bought mines used and don't know if they are. I also live in so cal and would need smog check next year. Let me know where I can get the document for that if they are legal

FYI, no FMIC is CARB legal either and, if there are visible changes in the charge pipes, you could fail the visual inspection during a smog test because of that. I chose the 5" Mishimoto FMIC because it retained the use of the stock fittings and charge pipes, required no cutting and was otherwise indistinguishable from stock from above. Other FMICs use the stock fittings as well but I chose the Mishimoto because it also came in black which makes it all but invisible behind the lower bumper grill. [/QUOTE]

Heres a link that will give you the test history of any car: http://www.bar.ca.gov/pubwebquery/vehicle/pubtstqry.aspx P.s. i always wondered why people are so scared about smogs, its not like the dmv suspends your reg. Or anything like that, you dont get fined, and most places offer a free retest, so why, if your unsure, just get a smog? |

Stocks will have to go back on to pass. Clear and simple. My buddies never did though and I'm sure they went through a shady route but I never asked any questions.

Thanks everyone for feedback, wanted to let everyone know that the Injen CAI is NOT CARB Appoved! I just got a email back from them b/c I could not find my sticker and they said(That intake is currently being carb approved and is in process pending approval. You should replace the intake with your stock air box for the smog check.) that's messed up b/c I got rid of my stock b/c I did not think I still need it. The whole reson I went with the freakn Injen is b/c they were the only one appoved

I've seen pics of the InJen intake w/CARB stickers on them and the guys at ModBargins also told me that it was approved. Injen lists this CARB EO#476-5 with Part SP1125 for the 2007-2009 335i. And, it's on CARB's list of approved InJen intakes BUT there's a confusing exclusion in the certification: EO: D-476-5 View PDF EO Date: 2009-08-31 Manufacturer Name: Injen Technology Co., LTD Device: Cyborg Intake System Device Type: Air Filter / Intake Modification SP1125 2007-2009 BMW 335i 3.0L 6 Cyl. (excludes LEV2, SULEV, test group #7BMXV03.0N51 and #8BMXV03.0N51) See: http://arb.ca.gov/msprog/aftermkt/de...eo/D-476-5.pdf Some people are taking the exclusion to mean that all 335i's are excluded, but that makes no sense. Why would they list the 2007-2009 335i as eligible for the exemption and then add an exclusion that revokes the exemption from all 335i's at the same time? The only explanation seems to be that the exclusion applies only to 335i's w/a N51 engine, since "N51" is the only thing specifically noted in the wording of the exclusion and that the exclusion does not apply to 335i's w/a N54 engine. So, if you have a 2009 335i N54, my guess is that the person at InJen who told you that the SP1125 intake did NOT have CARB approval was mistaken. In any event, given this confusion, I'm REALLY glad that I did not buy one. Good luck!

Ya I had got mine from Mod Bargains a couple years ago and even the salesman at the time said it was legal. I just talked to Mod bargains today
and they said that it was never carb legal. |

Did they ever give you an explanation why your car was subject to the "exclusion"?
