Never been into a car accident till last month.

Long story short i was involved in a 3 car collision, the person that rear ended me lied to my face and i believe it, until 2 weeks ago, i looked at recorded video of the aftermath, and found he was the one that hit me. First question.

Only 3 cars pulled to the side of the road, me, the car i hit, and another car (who was later found that he hit me)

I am fighting insurance to have my car repaired by the liar.

Does the damage on the silver car match the damage on my 330i?

I dont want to make this story long, but the person i rear ended, confirmed that the silver subby was the person that rear ended me, yet he lied to my face.

Assuming i win this case, would the car repair my rear bumper and body damage done to the rear, and passenger fender, front bumper and light? Or will they total the car? Pictures of damage here:

More than likely totaled. Depending on the state and insurance company and how close to the line of fix and total, you may have some say in that.

That thing is going to be totaled. The 1/4 panel looks pushed and that alone would total it.
The front end damage is even more reason to total it.

Didn’t you already fix the front end?
Why would you fix it before talking to the insurance company.

Its mickey mouse'd as heck haha. Well like i said, i thought the person that hit me ran away, but later found out who it was, by then i had already fixed it.

Ya that is totaled, the value on a 2006 330i these days is like 4 grand - just bought a pretty mint one actually for 4500 with 80k miles and everything on it, so they will total one out at 2500 or 3k in damage and just new bumpers and paint will pretty much do that, add the fenders and other damage and it is probably done for.

Most likely totaled The insurance paid me 2500 for the rear bumper and 1 taillight damage on a 06. 325

I replaced the light for $50 and leave the bumper as is

based on the pictures it looks totaled. The person who rear ended you will be 100% at fault and you will be 100% fault for rear ending the other person unless you stated that the car who rear ended you pushed you into the other car but that doesn't seem to be the case. I will guess the silver car's insurance company will only pay their share of the damage or 1/2 of the total loss.

I've been wondering the same thing. I have hair damaged on my room. It's not bad but like if you get up close to it you can see it. I thought about Insurence claiming it but didn't know if they would fix it or consider it totaled and pay my loan off? If they did pay my loan off they would be cool. I would just buy it back from the Insurence as a salvage title real cheap and continue driving it lol

Totalled 100%. Once 75% give or take of the total value is reached in repairs the insurance will total it. Fender w/ paint and labor is 800, both bumpers w/ paint and labor is 2k give or take and headlight is 1k. Plus any other hidden damage, you said you have body/frame damage in the rear, another 1 to 2k give or take. If you do buy it back I would just look around on ebay or craigslist for used body parts matching your color, very easy repair if you got the tools, time and space. Good luck.

Definitely a total! Fight it all you want, insurance companies have power to decide on what they want to do.
You will have an option to buy it from them or through a salvage auction (usually with a dealer's license).
Besides estimating the damage, insurance companies also consider year and mileage.
Even if the damage is very small like a bent fender or bumper, they will total it if the car is old and has a lot of miles. There are many factors that contribute.

Each US State has hundreds of laws that regulate how insurance companies can operate with in a state. The OP can go on line and educate himself on what the laws are that allow his insurance company to determine if the car is totaled. Each State has law that determines the formula, and law regarding salvage.

OP go educate yourself before you begin negotiation with the insurance company. Your car sadly, will be declared a total loss. The rear damage bent the unibody, which can be repaired, it's just more in cost than the car is worth. Also, with these cars, any replacement of the HID headlight is $1,300. Add a bumper cover and fender and it is $4,000 minimum.

Assuming you win and the other guy is at fault, then yes your car is totaled. Your car is worth maybe 4 grand so almost any accident will total the car out. You will have 2 options after the car is declared totaled.
1 they give you an offer for your crashed car and they take your car

2 they give you an offer which will be less than option 1 but you keep your crashed car.

No repairs will be done to your totaled car unless you choose option two and you choose to repair your car on your own.
