Wow. The BMW warranty becomes just words more and more each day (unless you are friends with a tech, or work at the dealership).

Did you pull codes before going to the dealer? How did they fix it? Did they just do the golf tee mod, or did they attempt to actually clean the debris they claim entered the system? Did they replace vacuum parts on the car?

Going to check my golf tee now!

I did not scan for codes because i have never had a tune, they didn't clean anything they left the hose just hanging and they lost my bolt to my heat shield, and my vacuum hose is connected and sealed up!!

I'm so sorry to hear Auria. I would pursuit this fully with BMW NA. I know a person who had his warranty voided on a M3. He then made a few calls, and while the full warranty was still voided, he was still able to get some work done upon approval by calling a different dealer and BMW NA covered the stuff for him.

wow...sorry to hear about that...this is exactly why I am holding off on any performance mods. it seems like BMW is jumping at any opportunity to void a warranty nowadays.

go back to them and tell them about this - that is if you fall in line w/ the Magnuson-Moss act clauses. See the Service Manager as well. If no compliance, then go to BMW NA. If still no compliance, then get a lawyer and file a claim against BMW of FFX and have them pay your legal bills, fix your car, and re-instate the warranty.

This is B.S. and is laziness. It is a reflection of technicians who are clueless and chalk up their lack of expertise and naive-ness to do something like this.

Your bad experience is a lesson for us all to learn. Sorry you had to be the one to teach us though.

I was thinking about getting a new larger oil cooler installed to help keep my temp down this summer. The Dinan S2 software has increased my normal operating temp to 246 degrees and we haven't even seen summer heat yet. Afraid of stop and go traffic on a 90+ day now. Found a good cooler for $700, and don't want to pay Dinan $1500 for theirs. Now it appears than if I don't get the Dinan unit I could lose my last year of warranty. Yikes!

So if you decide to put aftermarket parts of your car which local BMW dealerships are more leniant? Outside of possibly Tischer which is a hike from where I'm located are there any good ones in NOVA? I'm located right near BMW of Sterling. Would anyone recommed a good SA there?

Guys, guys - while we all feel sorry for the OP, we must also recognize that the MM act does not apply - regardless of what SEMA would like us to believe.

The MM act restrains a manufacturer from refusing warranty service based on the mere fact that an aftermarket replacement part was used that is substantially similar to the OE part and meets the manufacturer's specs.

In this case (and in all cases where the replacement is a "performance" part) the replacement part was not "substantially similar" to OE as it was intended to change the performance characteristics of the car - however slightly.

In order for the manufacturer to prevail, they merely need to show that the part was not built to the same specs as required by BMW and that the part "could" have caused or contributed to the failure.

So what does the MM act cover? It allows you to use a variety of lubricants instead of the BMW brand (as long as they meet the required specs) or that you can replace a OE Bosch light bulb with the equivalent Osram or Sylvania bulb - assuming that you are using the bulb that Osram/Sylvania cites as a "direct replacement" for that particular bulb - that precludes the use of those "blue" bulbs (since they are not substantially similar.)

Now - back to the OP's issue.

He needs to get, in writing, a statement of why they denied warranty service and what systems will not be covered in the future. Thereafter, you should contact an attorney and have them contact BMWNA - why? Because right now you have a car that you cannot sell and future repairs will be on your dime.

Now, for the old fogey PSA - consider the unexpected consequences on ANY mod and weigh that against the benefits of the mod. The OP learned this the hard way but he can fix it - if he takes quick action.

Damn, it's like there are constant reminders on this site of why we shouldn't go to BMW Fairfax. That's nuts. What is this vacuum hose you guys are talking about? Why on earth is there a vacuum hose connected to the exhaust at all? Does it lead back into the intake manifold? Is it the EGR system? Sounds very fishy.

This whole issue with BMW and warranties is beginning to sound like Mitsubishi when the Evo VIII first came to the US. The dealerships were completely voiding warranties for every possible mod, even a turbo timer or boost gauge.

The vacuum hose is used to keep the flap in the driver side muffler closed. A lot of people here do the "golf tee mod" which basically consists of removing the vacuum hose and plugging it with a golf tee so the flap is always open.

To the OP and anyone else who may have had issues with their dealer, I highly encourage you to file a complaint with the Motor Vehicle Dealer Board, which is the Virginia regulatory agency for car dealerships:

If they receive enough complaints about a dealership, they can take civil action against the dealership.
