EPA may hold certain 09 models until 10/24???

The EPA thing is done. They finished ahead of the Oct 13 expected date.
The hold up now is CARB on the 09 *35 cars. Expected date is somewhere between Oct 22-27th. The impression I got was that its no big deal, and approval is not an issue. But the signing off by the bureaucrats will happen on the bureaucrats time table and there is nothing BMW can do about it. I would assume they don't like cars sitting there. Especially, my poor imprisoned coupe. Who wants a car with red interior sitting in their storage lot taking seagull bombing runs. The Port storage and the actual BMW facility are adjacent to each other so no need to truck transfer cars. Last I heard the cars on hold were still sitting in port storage. Now I have to go feed my seagulls for delivering me these rumors. |

So I've got what would be a depressing theory on the hold up. I think there has not been a hardware change on the N54 to address any waste gate rattles. EPA certification includes software and since BMW has modified the software ala 29.2+ the EPA may have had to review the new vehicle performance. With all the reports of people seeing fuel milage drop from pre 29.2 to post I'd be interested to see if the 2009 mpg numbers get revised downwards. Maybe this delay will teach BMW not to detune cars...

Follow this link for CARB info.
It confirms MA, ME, CA, WA, OR, NY and VT are CARB states. NJ state website confirms their participation too. FL was considering it in 2007 but could not find any info on whether they adopted it. Hope this helps. |

not a CARB state?
Well, apparently Indiana is NOT a CARB state. (Not that this is surprising.)
BUT,... My dealer was originally telling me that my car (2009 335) arrived in port on 9/30 and that I should expect it in 5-7 days thereafter. I was pretty stoked. Now, I am still waiting and they are being sketchy about it, but telling me that they no longer expect it until 10/24! Ouch! They did not ellaborate further. |

As I said yesterday, my CA said 10/28 which was his official notice from corporate. I'am going to try not thinking about it and expect my E-93 some time around the 1 st of Nov/08. If it comes sooner thats great.

I also spoke with BMW NA.. it is confirmed the EPA is holding up the cars but the customer rep did not have details on when the process would be completed.. but to expect some delays in this first batch
oct. 28th sounds realistic though

it doesn't make a huge difference but is it rumored our cars will be shipped out from the vpc on the 28th, or is that the day they will be arriving into dealerships? again, not a huge difference, but still curious. thanks.

I would not think there would be an emissions hold on non-CARB cars right now. However, I have heard that some dealers near the borders to CARB states will order CARB cars so that there are no issues selling to out of state residents. An example might be Las Vegas dealers that like to sell to CA residents who fly in have a weekender and buy a car. Must be nice.

My car, E93 335, has been at the VPC since 10/2. I live in MD. Any chance it will be released soon? I can't get any information out of BMWNA or my CA.

After finding out that people who had (non-turbo albeit) cars on board my ship (Traviata) were notified that their cars are being delivered to dealers in Washington State today, I had a 2 hr+ meeting at the BMW dealership today with my CA and the dealership manager to figure out what is going on. The manager called the grand poobah at the Oxnard VPC and asked exactly where my car was and what was holding it up. The VPC manager says that my car hasn't even cleared customs yet (but that it appears to be unscathed from its great transoceanic adventure - yay!). He said that there is no EPA hold on my 335xi and that it should be processed within the standard timeframe (3-14 days). Maybe the EPA is holding them in customs while things are sorted out?
I'm even more confused now as I can't believe that a car that I ordered and paid a deposit for on August 3 (and that wound up in Week 36 production) is so far back in the processing line that it's sat there for 5 days untouched. I have no idea what's going on at this point and I'm just going to re-set my sights on the delivery date the dealership gave me in August, which was November 15. Let my BMW go! |
