I've also heard that BMW disputed the MPG rating... I have no idea if there's any truth to that or not.

There's no disputing it has been about 72 degrees at 7pm at night when I go home. But, the top doesn't go down on my maxima rental, so that really doesnt matter.

yea, none of it really matters.... we don't have our cars and I can't stop thinking about it. I miss living in SD... It's a little bit cooler in the high desert

EDIT: cooler as in less warm, not more awesome, because SD is the best place on earth!

My dealer's contact at the VPC confirmed the EPA hold (FINALLY!) as well today. He also says that the cars are slated for an Oct 29 release. I hope the 24th turns out to be the winning date, but I guess I'll focus on the later number and hope for a happy surprise.

I understand that all the cars headed for Hawaii have to be prepped with a special sun repellant wax and a pineapple air freshener installed in the ventilations system.

ugh, if it's the 29th, i won't be around to pick up my car i have this growing fear that the dealership is going to sell my car while i'm away even though i know they aren't suppose to do that. but what really would stop them from selling it if someone came in and wanted to buy it off their hands?

HAHAHA, i honestly was feeling pretty down about the car until that post but no, 335i montego coupe. what's scary is that my CA never took a deposit from me since he said if i were to back out of the deal, "it would be VERY easy to sell the car". then again, he said that before the economy went into the pooper. i do however have paperwork saying it's been sold to me.

again though, really, what would stop the dealership from selling my car if someone offered them cash upfront for it? if they sold it, would they be breaking any laws? or would it just be morally wrong? i swear though, if it's not there when i return from my trip, i'm going to raise holy hell in that dealership...then proceed to buy an audi

They have to tell you can they sell it. It isn't good for negotiation of they say "thank you so much for buying this because it would be on our lot for 6 months". My dealer told me he can sell ANY convertible with auto for MSRP. I think thats a little exaggerated...

I don't think there is anything legally wrong, but certainly not ethical. Either this forum or another bimmer forum has a story where the car was sold and the CA claims it was a mistake. At any rate, I am surprised he didn't take any deposit. Is this common?

we can't sell it

When I ordered my 2006 S4 in the fall of 2005, they actually told me that they needed the deposit, because if I backed out they would be stuck with the car. It was red, nothing unusual. As it happened, they got another red one in with mine that sat on the lot for a full year before they could clear it out.

In a way, I would be a tad nervous as well, because their lack of having taken a deposit denotes their confidence in their ability to sell the car without it. I picture some sort of SNAFU confusion occuring on a day where your sales person is not in and some other sales person "sells" the car for sticker! That's the kind of thing that would happen to me I would just arrange to place a deposit or at least otherwise communicate your concerns.

All this being said, you are still a customer and I doubt very highly that you would intentionally be treated this way by any dealership.

Don't know if this is good or not, but my car actually moved this morning. It's "At the Vehicle Preparation Center" finally (arrived PH on 10/6) according to the Owner's Circle. My CA just yesterday said it was still showing at the port on his system. I'm not getting excited about it, but at least it's progress. Maybe the rumors that the EPA got done early are true?

update from the EPA

I've been sitting here watching all the speculation and thought to myself "why not ask the EPA?". So I left a voice mail for the engine import team and got a call back just now. He said that the EPA doesn't hold up cars for certification. He said that car manufacturers have the responsibility to certify. The only reason there would be a hold up is if BMW didn't provide the right information requested. In hind sight, I probably should have asked him for specific information on BMWs, but I think my VM mentioned it. However, he flat out said that they are not holding any cars.

Good thinking, but typical bureaucrat response. He said that the EPA doesn't hold any cars, flat out, EXCEPT when BMW doesn't fill out the proper TPS reports in triplicate? Nice....

Unfortunately, OC updates don't really mean anything. Owner's Circle is anywhere from two days to a week behind reality. My car has been at that status for the last week and half.
