I'd have it inspected by a good indi, if it turns out to have something like a gearbox issue, I'd be taking it back and asking for a refund. Especially with an autobox. They can be a real money pit.

Did they not give you any warranty with it?

No warranty other than paying for a RAC one. I'll have an indy look at it but tbf I find it werid he's accepting a full refund ( I know it's law) but not wanting to fix the fault.

It looks like I may be looking at getting a refund. I plugged carly into the car and the following codes come up

Engine / Motor
Fault Code: 004E0F
Fault Explanation: Swirl flap, plausibility
Fault Code: 004A1E
Fault Explanation: Glow plug cylinder 6, control

First one I am not too sure about, second one could the faulty plug or controller?

The Swirl Flap code will be due to carbon build up in the intake, it usually pops up when the flaps don't open/close as quick as they should. I had that code for ages. A clean of the intake manifold will sort.

The glow plug code is almost definitely the controller, again I had the same thing for ages, I would replace that first before forking out for plugs as I would bet that you don't need them.

Quick update: I returned the car yesterday and got a full refund for what I paid. They wanted to take the car to their mechanic to "inspect" it but got proper arsey when I wanted to come with them, which I ended up doing. I'm off to look at another 325D, hopefully without problems. I've taken carly adapter with me. Everyone who's commented on this thread I owe you all a big thanks and a pint for helping me out!

Cheers
