got pulled over yesterday.... any advice?
ok so yesterday i went to see my girlfriend in queens and i was on union trnpke at around midnight and i made an illegal u turn.. is there any point in pleading not guilty and fighting the ticket? it says on the ticket that there was a no u turn sign. i heard that if i pay a little more than the amount of the ticket then they send you back a refund check and if you dont cash that check than the points dont actually go n your record.... is there any truth to this? thanx in advance guys any input is appreciated

i got a ticket for the same thing, i went to the police station and they said if there is a double yellow line or a sign there is no point in trying to fight it, you will lose and at least in ct if you go and lose you get points on your license and if u just pay you dont get any points. i just paid mine and my insurance never went up or anything and that was 2 yrs ago

Get a lawyer.. Depending on your record you shouldn't end up with any points. You'll just end up paying the lawyer and probably a lesser violation.

This seems like a pretty hard one to fight. Go back to that intersection and check for the sign. Sometimes they get torn down from wind, etc., If that's the case, you could probably fight it. If not, then hope the cop doesn't show up if you want to take it to court.

A: The extra money check is an urban legend. Completely false, and you'll lose your money
B: You don't need a lawyer C: Be Smart, dress well (suit) go to the court and deal with the prosecutor first. Tell him that you have a clean record and that you would like the charges dismissed, that I won't happen again. If he says not, at least he will ask you to plead guilty to a reduced charge like unlawful operation of a vehicle; which I guess, has no points value. D: Next time B careful |

That's what I did, still waiting to see what happens. I got 2 tickets at once. I gave them to a Lawyer and he'll take care of everything. I don't even have to go to court which is nice. I have a clean record, so I'm hoping one will get dismissed and one brought down to lesser points.

yea but sometimes even a lawyer wont do anything and you just paid 600 bills for nothing.best bet get there early, dress nice, talk to prosecutor. if you have a clean record, he will drop it for you. say you were unfamiliar with the road and didnt want to get more lost than you were, so you decided to make a uturn. you made a safe one; checked both ways blah blah.

here is your urban legend
http://www.snopes.com/autos/law/ticket.asp Go ahead and send them extra money they will be more than happy to keep the donation to the policemen's ball. Lastly, on what ground are you going to fight a illegal u-turn. it is pretty simple either you did or did not do it, unless your saying there was no sign, but I think for toll roads and turnpike it is standard that no u-turns are allow no matter what even if it is not marked. |

the point of going to court isn't to fight it, but to get it reduced..
union tpke pisses me off with all their no u-turn signs. i always have to turn into a side street to get myself around.. |

Coming from a person who unfortunatly has faced alot of tickets.. including speeding. The best advice i can give you is , go to the courthouse 15mins before the hearing time, try to catch the cop beforehand and ask if you can pay the fine, but cut you a break on the point. Mention that you understand that you made a mistake but cant afford to get hit by the points. Work EVERYTIME... at least for me. Most likely you would go into the courtroom and the judge will ask the cop what he thinks should be done. And the cop will say that you will be PLEADING GUILTY to the FINE, but NOT GUILTY to the POINTS.
Good luck and may the force be with you haha. You should be fine. Its not worth to get hit by points for something so stupid. If you were changing lanes without signal and riding up on someones ass.. then i would say too bad. But not in this case.. FIGHT IT! |

Word of advice, from experience. It is up to the officer to prove that you committed the violation. If he is off on any important detail, such as date;time;location;etc, the summons would be dismissed. A lawyer is helpful, but not neccessary. It is in your best interest to test his knowledge. Worst case scenario is that he is good & you get found guilty, but depending on your driving record, the judge might be easy on you.

I would say just to pay it. In my experience its not worth it to even fight you will get mad postponements and if you work/go to school its not worth it too loose all those days for a few dollars, but if its points and you can get those knocked off I would say fight it
