1) I do plan to go speak with Joe on Monday, this does mean I have to leave work for an hour, something that in this economy isn't exactly how I'd like to be spending my time doing.
2) The rattle that I brought the car in for was on the rear deck so they told me that they disassembled some of the hardtop mechanism to get at it; and when they put my top back together it, voila, doesn't work. And they tried to give me my car back THREE (not once, or twice, but 3!) times claiming the top was fine and when I'd try it it doesn't work, so it's not like they're waiting to hear back from BMWNA, they've been trying to foist the car back on me, broken! My hardtop was fine when I initally brought it in, so yes, they broke it.
3) I get the strong impression from them that they're scared to get BMWNA involved.
4) I didn't even mention that they've stained my Cream Leather up real nice.
5) These types of things clearly aren't uncommon at Perillo, because the car porter didn't take my loaner away until after I'd tried out my car this morning (and found it still broken even when they said it was fixed). He told me that customers frequently have problems with returned cars and therefore they found they were wasting time parking loaners that customers would have to take right back out again.

I would file a case with your states Consumer Protection Agency and BBB. Check and see if the dealer is a member of the BBB and if so, there are usually rules with dealing with such cases. I am not sure about IL, but in CT they do investigate and you can search the database for cases against dealers and resolutions if any. Also, contact the Attorney Generals Office to see what your rights are in this situation as a consumer -- your AG will also have a Consumer Protection arm of the office for which you can file a case and which may also give them a "friendly" phone call.

If they broke it, they need to fix it -- something tells me they are not boning up to the mia culpa and know that BMW AG will not pay and don't want to spend their own money to fix their own screw up.

For any legal action, you should be documenting in as much detail as you can who you talk to, time, date and what they said

In N.Y., at least one party has to consent to the recording.

In Illinois, I think both parties have to consent and I would not counsel the OP to accidentally engage in a criminal act.

Oops, I left the record button on...

Of course, if the device is in plain sight, no consent is required. And the device could be a camera with a sound recording feature, it doesn't have to be an obvios reel-to-reel tape recorder. It just has to be in plain sight and not deliberately disguised.

First off, I feel for you. Second, the public isn't going to get behind you. Come on. People aren't going to grab a bunch of torches and pitchforks and mob Perillo for you. Wall Street just got hammered. Folks have their own problems. If I were you I'd turn away from the forums and talk to a lawyer. Perillo isn't stupid. If you have a legitimate claim, and it sure sounds like you might, get a good lawyer and meet with Perillo himself. Get tough. Write so many letters to BMW NA that they'll wish they never heard from you. Nobody here is going to start a movement for your BMW. They're trying to hang on to their savings and their homes. Chicago has some great lawyers. Get one that'll put the fear of God in Perillo Jr.

Where in any of my posts does it ask the 'public' to get behind me?
I posted because:
1) I have no experience with getting royally screwed by a dealer who broke someone's car, so I'm drawing upon the large community we have here and that I have participated in to see if anyone else has had this problem.
2) Warn people about my horrific experience with Perillo.

And please don't lecture me about the economy, I got laid off in January, so I know how it is (fortunately another firm was trying to hire at the time so I found something quickly - I am eternally thankful for that).

ucla, sorry if I offended you. My reply was part tongue-in-cheek. I was trying to help. I will try once again. I have bought 2 cars from Perillo and my experience has been outstanding. I worked with Ken Reffsin and he was amazing. The reason I suggested you get a lawyer is simple: Perillo Jr. is not the heart and soul of the place. He walks around asking people if he can get them a cookie or coffee for Christ's sake. He's the rich kid who took over the place and likes to star in his own dumbass commercials. Trust me, you bring a lawyer in there and it'll make an impression. Write letters to BMW NA so that they hear you loud and clear. Call them. Be the guy that won't go away until they do right by you. File complaints left and right with the state, with any other agency you can find in Illinois. Raise living hell. Make them want you to go away. They're very conscious of their rep in Chicago. Most of their business is repeat or referral. If you bought your car there, lean on your salesman (if they're still there). Hell, try to get a hold of Perillo Sr. and bend his ear. I know it sucks. I really feel for ya. Good luck, and again, no offense intended.

I think it´s still slightly premature to get a lawyer involved since that would mean that the OP has to pay for it.

I would escalate the problem through various channels, incl. the aforementioned BBB.
