There is also evidence on their part that they contacted you about the IBS cable damage. You saying "They lied" is not evidence to any of us that they didn't contact you. Their job is to inspect your car and advise you of problems. They found a damaged IBS cable. They claim to have contacted you for the repair. They, as a business, would not exist if they perpetually lied to their customers about approving work that was not actually approved. That's a serious crime with serious consequences.

If they did not contact you, then a more reasonable explanation would be they called the wrong person. It's unlikely because they ask for you directly by name, but it's not impossible to make that mistake. It's much less likely that they're picking you out and specifically lying to you about doing work that wasn't
actually approved, and you'd need some real hard evidence to prove that hypothesis.
As someone who was a service advisor for 5+ years at 3 different high line dealerships, there is no way a dealership did work that you (or someone) didn't approve. It's highly unethical, everyone today has a voice and can leave reviews on the internet, and at all 3 places I worked, we had more work than we knew what to do with.

Either the OP is lying, they called and someone else answered your phone and approved it (this happens more then you'd think) or the SA miss dialed and got an approval from someone else (I've never done it but I could see it happening)

The SA makes so little off selling you that repair (maybe 5-9 dollars) why would he/she risk their job over such a petty amount?

How do we know that you're not lying to try to make a few bucks after declaring bankruptcy? You know what, let's use your logic that you've been using in this thread: you're a liar playing a victim to get money from another company, and using this forum as a way to garner sympathy from others and provide a really weird way of logging your experience. Prove it otherwise.

Evidence is coming soon. Mark my words and see yourself. When the time comes for a new car, im still young, BMW wont get a dime from me or my family tree for generations to come.
This thread is like a car enthusiast's day-time soap opera.
OP, just cut your losses here and at the dealership.
As you said, you're young, so learn from the experience and ensure you improve your communication and troubleshooting skills. That'll benefit you in life and job, and you'll be able to afford a better car.

I agree that the way the OP worded his posts he comes off as over the top and whiny, but why are there so many dealership fanbois in this thread? To say there is NO WAY this could happen is silly.

I've had all of the scenarios that the OP is describing happen to me when dealing with the Nissan dealerships in my area. One dealership damaged my car and refused to repair it until I threatened legal action, another performed work I did not authorize, a third lied about warranty work they "completed" and on another occasion tried to charge money for warranty work, and I could continue to add some smaller stuff to this list if I wanted. And this all happened on a car under warranty, that was less than 3 years old...

Tough situation and there's always both sides to the story.

The cut battery wire line item shows there was exposed wires but sounded like it was still intact, which could explain how he was able to drive the car still. Hard to say it wasn't damaged before it went to the dealership because inspecting the battery connections would not be a normal procedure unless you would need to access it for work. I have yet to look at my own battery after buying my car since I haven't done any work needing me to disconnect it. I could have a cut battery cable and not know it either! The oil level can be contributed to the leaky valve cover gasket but it looks like that was checked already.

Obviously being in an unfortunate financial state exacerbated the situation and made you feel taken.

You could try to dispute the unapproved work, but it doesn't seem worth it if I was in your situation. If all warranty work was done with no charge, I would move on and go to an indy mechanic for the other issues. $350 is still $350, but the time and cost to sue would definitely cost more than what you would get back.

Very sorry to hear about your finantial misfortune and I hope everything gets figured out. Yeah, your best bet is probably an Indy mechanic. Also, if youcould switch/trade the car for something a bit more manageable that might not be a bad idea, just until you can get back on top and more financially comfortable. It would stress me out greatly to burn through a pay check like that and be stranded after emptying my whole paycheck. And I truly do sympathize with you, we just recently had hour cutbacks where I work which is affecting me financially. We also just had a baby and my wife is not working. It's tough out there right now. Best of luck and wishes to you OP.

I agree with above ^.

I'm sure we all love luxury items and drive nice cars, but at the end of the day, do what's best for your situation. Make things easier on yourself and sell the car and buy something to hold you over until things get better.

I just sold my 2012 Toyota Prius, option 4 with heads up display, leather seats, navi, back up camera, and solar roof, 77k miles for $13k. Lower optioned cars go for $8-10k. $31 to fill up a full tank and I got 400~ miles per tank. Cheap insurance and cheap maintenance. I would not have sold if I didn't already have a 2nd Prius, plus 2 other cars.. Hang in there. We all go through ups and downs. Best of luck.

Jeez, that doesn't seem like that great of a deal. I get nearly 400 miles per tank and it costs me $44 to fill up. For $13, I believe I would rather drive my E93 than a Prius.

How much would it cost if your gas cost $4 a gallon where I live? Your E92 has 15.8 gallon capacity. Let's round it down to 15 x $4 = $60. That's half of the cost. Devil is in the details.

Keep in mind, OP is in a financial bind. Lower maintenance, lower insurance, lower gas expense. We're not trying to compare which car is more fun to drive. We're discussing cutting costs considering he declared bankruptcy.

OP never paid for unapproved work, only diagnostic fees.

Fair point, and forgot about the BK.

FWIW, I pay $2.48/gal. for my 16.1gal tank (E93)

as others said, even what the op is true it would not be cost effective to sue for such a small amount.

If $350 seems a lot to you, i think your better off just selling the car and buying a used corolla until your financial situation improves.

One maintence item on these cars can easily be over $350, especially given the age of these cars.

1. The invoice date is between 10/19 and 10/31. Your call log stops at 10/24.

2. Companies typically have multiple outgoing phone numbers. Occasionally, SAs will call from their personal phone or their work phone, if issued. For example, my SA during my recall did not call me from the dealership's number.

Why did you stop before 10/31? Have you verified all of the phone numbers in the call log? Where is the call when they said that your car is ready for pickup?

You had one incoming call on 10/23 outside of your area code. Have you brought this to them and told them that you can't find the time in which they said they contacted you?

Not a chance in hell I'd call a customer with my personal number. its just an invite to be called while not at work. And that is speaking from experience :

Stick to facts that you can document. Call logs are a great start.

Take it to small claims. Anything else about your feelings or inconvenience will be ignored by the judge.

My SA was a pretty risky dude apparently He was calling and texting me from his own number, and encouraged me to call him with any issues. I felt that was really cool, but I also felt really bad texting him so I didn't unless he texted me first.

They already did the repair for free. What is he going to sue for?
