This is such $%$%^, I feel really bad for you. The cops must be on a power-tripping binge. How could a little spirited driving result in suspended license for a year?! That's ridiculous, the punishment does not fit the crime! Hell, lots of people are busted for speeding in HK every year, many of them can get off with points deducted and that's it, unless they really go way above the limit. This sounds really unfair for you. I say consult another lawyer and consider appealing.

I was 158 / 50…. Main point for posting my experience up was to warn everyone that due to recent events the penalties are very much heavier. You guys would be more pro then me…. First time suspension is 3 – 6months with fine based on the offence committed. Second time suspension is 1year with fine based on offence committed….. In our case all of my friends except one is first time but instead of the 3 – 6months we were slapped with 1year and 10k fine…. That is almost us committing a DUI. According to our lawyer yesterday all those that were present was slapped with the same penalty other than those not petty traffic offence. So really becareful during this period….. I might still drive but short distance from hme to work or work to hme….

Hmmm, I'm not very familiar with road traffic law, but in general, sentencing is at the discretion of the court but there are sentencing guidelines. I will have a look for u.

If I may comment... I think the Government is not doing anything wrong here...
They understand there is niche market for sport cars... They know most of us Mod their car, and they just look the other side... How many times have we driven next by cups or check points and honestly, my son can tell that these cars are modified and we were never pulled out for that... The time the police step up is when you go beyond your limit... Racing on the streets of HKG is illegal. Period!! whether you are on a horse or in Buggatti, a Bimmer with all licensed mods or not... Now when you get caught being outlawed, it is very normal for them to start looking into what you have done to your car... If I am not mistaken, Ken Ken did not get penalized because his car was modified and not certified (or am I wrong??) he got penalized because he was doing a 158 kph on a 50kph limit... Not that in most cases this 50kph is ridiculous.. but this is how it is.. And will have to take it, or ride our bicycles instead.... PS: my son is just 17 months old, so I will be shocked if the cup can't tell that your car is modified... |
