Has the boot floor been damaged?

What about the battery tray?

What about the bumper mounting leg?

Seems a shame to write that off if it's only cosmetic damage. If the chassis, mounting points and suspension setup are fine, then personally I'd get it repaired

If op's insurance were to allow a repair using reclaimed parts the repair cost should be cheap enough to avoid the car being written off.
My e36 328is would have been written off had new parts been used, as it was repaired using reclaimed parts it became a viable repair & didn't become a write off.

I need to get them to agree to the fair market value 1st. Then I can discuss buying back.
But it will be a categorised car which will impact insurance and resale. So I need to think about that moving forward.

Personally, in your situation what I would do is get a decent price agreed, buy the car back and either repair it or sell it on as it is with the damage to recoup some cost.

The worry is always what it looks like once the bumper comes off.
The pictures do make it look like light damage.
1st step for me is getting the insurance company to either pay out the fair market value or agree to have the garage it is at repair it. Once I get this sorted then I know what the next steps are.
The jokers have tried to offer me "an interim payment" which I have pushed back. I am one step away from the Ombudsman which is a route for them I hope they do not want to go down.

The best option is probably just to stick it on ebay as it is once they've given you a decent valuation and you've bought it back and let it be someone else's problem.

Good idea about ebay. I should know where i stand next week.1 step away from the ombudsman at present. The FSO website has given me extra ammo to through at the insurers which i did today. And I am now using the resolver website which is helpful.

Update - They paid out in full. They say the independent valuation was what enabled them to increase the amount. They said their department that deals with the FSO review the case...with the proof I provided and references to statements on the FSO website I'd say they knew they would loose so they paid out.
The car is with copart salvage currently with a bid of £2,150, very odd as I told them once they agree the payout I'd like to discuss options to buy back. Be interested to see what it sells for and if the new buyer gets intouch as I have stacks of history for it.

Thank you for posting this. Unfortunately, this happened in the UK and the cars on that link are US-based.

I got the right result at the end of the day. Just wish I didn't have to go through the hassle to prove I was right...

They repaid your purchase price?

Did you have chance to remove your mods?

They repayed my purchase price. But daily calls,e-mails with multiple supporting documents and quotes from the fso site was how i got it.I think it was fair. I didn't do the mods as only had the car 17 days. When the insurer wrote to car off they sent it straight to copart. So no chance of seeing the car again. I did say i would be happy for it to be repaired but i believe it had already gone the copart so was easier to try and get me to accept their settlement figures.

Heyy buddy. Apart from the bumper and quarter panel, I am interested to know how much damage is on the car. Is the car still drivable and were the wheel/suspension, battery compartment, fuel cap system etc also affected? And if possible do you have anymore pictures? It's family time and it might me time to part with my e93, ha.

Hi Ozzie - Are you planning on bidding on Copart?
Car is/was drivable, I am no mechanic btw. All the areas you mentioned above worked with no issue.
The only pictures I have are what I posted up. From eye witness accounts the person who hit the car wasn't going fast as they had been looking for a parking space.
If you do end up getting it do let me know as I have the service book, invoices, and the 2 original BMW wallets. It would be a shame for these to not be reunited with the car. Oh and I have the tow bar which is removable.

Thanks for the info. I am going to try by all means to convince my 'accountant' that two 335s in one household is exactly what we need. It does help that we are expecting and that she is not fond of my current e93. I will keep you posted buddy. Many thanks again.

Well the E91 is a rare model so at least in theory it won't loose a packet. And I suspect you will get it for less than what I paid for it. And as you are in contact with me on here and live in London like me it won't be hard to grab all the paperwork so at least it will have history. Good luck, it was/is a great car. Previous owner to me really looked after the car so I'd say its a good one.

Just had a look at it on copart, current bid £2,300, reserve not met.
Looks as though there's some front wheel/suspension damage as well.

There was no front wheel suspension damage, the car was parked and hit on the rear drivers side corner.

What in the pictures makes you think that area has damage? Is it the writing on the wings?

The previous owner had KW comfort street suspension fitted and in my opinion it is too low, rear arches had been rolled.
