So I've been hearing some recent F30 328i buyers are pretty pissed because when they bought their F30 for HK$555,000+, BMW HK already got the environmental exemption and so could have been cheaper by around HK$75,000 (as it is now the case), but only after they bought their F30 did they discover this. Now some of them are demanding BMW HK to payback the difference due to the environmental exemption.

I don't know legally whether those buyers have any ground (misrepresentation? hard to prove). What do you guys think? Was BMW doing a dirty move? Or was it 100% legit and the buyers were just "suckers"?

Is that if ordered the car at $555k but haven't 出牌 yet you still can enjoy the $75k off from the HK gov? That's my understanding.

It doesn't sound like BMW Hong Kong's problem. First Registration Tax is collected by the government, I think the ball is in their court to refund the excess paid.

I think BMW Hong Kong should probably help process the refund since they collected the money in the first place, but thats it...

Those buyers were saying that BMW already qualified (and received the deduction) from the government regarding the environmentally exemption, yet did not inform the buyers when they were purchasing the F30, and BMW also did'nt change the listed price as well (telling them the price is HK$555,000) when they already received the deduction from the gov. So I'm curious if there is any kind dishonesty on BMW HK's part.

If that's the case, then BMW Hong Kong committed fraud. The whole point of the EFV exemption is to encourage buyers to buy, well, environmentally friendly vehicles. If BMW got the concession and were pocketing the money they're going to be in big trouble.

Some of the buyers claim that, although I don't have first hand knowledge of this so I hesitate to say the buyers are really the victims until I know the full story.

obviously BMW concealed the fact that the MY 2013 would have EFV concession and did not tell the then prospective buyers so they could sell the MY2012 stock !

but the remedy is to have government refund the EFV concession to the buyers !

That really sucks, sorry to hear that.
I think the key here is to figure out why the 2012's didn't have the concession. If BMW tweaked the ECU or changed some mechanical part on 2013's in order for it to meet the threshold of an EFV vehicle, then you might be stuck. However, if they're exactly the same cars, then the government should be obligated to return your money.

Did they say what brand of car that dealer was selling? How did the seller (or the police) find this out?
