2) What kind of leverage are we talking about here? The others that are trying to get BMW to provide them cars have an obvious need (they turned in their leases with the understanding of a certain delivery date range, etc.). I don't understand your apprehension. If you have a need for a temporary car, then you have a case for BMW providing that for you while you wait for whatever governmental machinations take place with regards to our imprisoned 335i's. If you don't have a need, then you shouldn't be asking. It's pretty straightforward.
thats what happened with me. they wouldnt pay after the first delay...i was originally told sept. 22 then was told oct. 6. then they called me oct 6 and told me it wasnt coming until the end of oct. thats when they agreed to pay for my rental until it comes in.....from oct 6 on.

1) This will be my first BMW -- I want it to be all new to me when I take delivery of MY car; wouldn't want the same model as a loaner
2) More importantly, I don't want to give the dealership any leverage against me!
I traded in my car because they told me the BMW would be ready in a few weeks (max). I have been without a car for almost a month now. I live in a neighborhood where public transportation is very limited and I have to walk at least 20 minutes to get to the nearest store to buy food.
For the past few weeks I have been ordering food because I don't have a car to drive to the shops.
Besides that, the weather has been perfect here in NYC and I would like to get out and enjoy it on the weekend. I've been used to having a car on demand and now that I ordered a $60k car, I don't expect any less.
They should accommodate me because I am not buying a Toyota here.
Plus, they owe me. I asked them to take out the Pioneer in-dash navi system from the car I traded in, and 3 days later, they told me that the car was brought to the auction and they could not do anything about the navi.
($1500 custom in-dash navi).

At least your dealerships are being honest about the delay. I can't even get an estimate on delivery (and I will have to wait 1-2 weeks beyond when you get your cars to get mine). My CA and dealership manager are still swearing there is no EPA hold and the fact that my car hasn't cleared customs in the week since its arrival is "normal."

When I told my CA on Sunday that I had read reports that there were many other people in the same boat and that those people from my ship with non-turbo engines were taking delivery, he finally had to admit that something might be going on. He's supposedly making phone calls as we speak although I don't hold out much hope for a good answer.

I was patiently waiting because I still had a car - until the engine seals blew 3 weeks ago - and I have 3-4 more weeks to go in all likelihood. If it makes you feel any better, there is no way BMW would give me a loaner or pay for a rental even if I asked. On the bright side, I've discovered that I really enjoy commuting on a bike. Maybe I don't need the BMW (but I still want it) .

just spoke to my CA and he said according to what he sees on his computer, my car's (335i coupe) work order (what is that??) was completed today and has been green flagged meaning it's ready for transport to the dealership. he said he spoke with others at the dealership (mountain view, ca) and no one there is aware of any emissions/epa holds going on. however, he was not able to give me an estimated time of arrival to the dealership, which of course is discouraging .

That's exactly what my CA told me too. Work order filled out, everything ready, waiting for a truck, etc. My CA was surprised to hear about an EPA hold on the car as well. At this point, definitely go with what you read here as it seems that the CA's are completely out of the loop when it comes to this edge case.

The manager of my dealership told me the EPA is holding all turbos for certification and I can get my car in a day or in a week...its not up to bmw.

Spoke with her last week.

My CA told me that the computer is showing 10/30 as the ETA.

Yea, my CA called me today and said to expect shortly after the 24th, that orginally it was a hold on the 5 series, has expanded to all twin turbo cars. I've been without a car since July, so they are putting me in something tomorrow! YAY! its not my 335, but I can ditch the Bus pass.

I turned my 07 in about 8 weeks ago hoping to have a car the first week in October. Now it looks like maybe the first week of November. This is worse than waiting for redelivery after an ED.

Replying to your signature really:

(since you are getting the V3P for it)
I was going to order the SSTT for my 09 e93 but I am worried about any software changes they might have done to it...especially since there are rumors going around that they made some changes to the turbo set up/ downpipe/ or whatever it was that was causing the rattle.
I'm scared the ecu might pick up the jump in boost and throw some error codes leading to the warranty being voided.
What do you think?

I think your dealership was crazy to quote you a Sept delivery date for a new model when the factory was shut down in Aug.

Yea, I won't install it until after I break it in, and I figure by then Shiv will have been able to check out the 2009. Hopefully they'll make an update for it.

I think you are mistaken. If your car is at the Performance Center it would have already cleared Customs and be prepared for Delivery.

this weekend maybe

I just got an email from my dealer. he both confirmed that my montego 335 has been delayed due to turbo issues and indicated that this should be resolved soon. I have copied as follows:

"Hi Craig, well our Rep. finally gave us info we all have been hearing about the 35 series engines and yes they all seem to be on hold for epa recertification. They all will be released this weekend. So 3-4 days from Jersey. I know the wait is a killer but it sure will be worth it. I will keep you informed as always. Have a great day minus the 335X."

So, that is good news right?

That is, except that "this weekend" is still seven days from the original blog post info of October 24th. The date of the 24th has been corroborated by various other posts in this thread, and there has also been semi-informed speculation that it might be until the end of the month.

In addition, the EPA is apparently done. We are now waiting on state-mandated emissions certification (CARB here in California, I dunno what it is in Jersey). All in all, it would be awesome if everything was done by the end of this week and x35's start to get loaded onto to trucks. But the way it's been going, I'm not going to hold my breath.

So you are flying or driving down to pick the car up in South Carolina?

Lots of rumor there. I lean toward the idea that the redesigned turbos may have thrown a kink in the works.
