Car Deposit Paid

HI, Is there any car traders on hear, or any advise.

This is not for me, BUT, a work colleague has been looking at cars so me being me I had a good look and found her a nice Polo. She paid a deposit of £150 as a holding deposit last night and was going to see the car on Saturday,

She decided this morning that she was going to wait until she has her full UK license, She has a continental licence and is going through the process at the moment.

The dealer has now decided that she is not getting her deposit back even though she let them know after 12hrs of sending them the deposit, trying to tell me that it cost money to re advertise the car even though the advert was never taken down and a holding deposit is non refundable,

Any one had this problem, I have always believed that if you pay a deposit and you change your mine then the deposit is refundable or if the car is not as described etc you get your cash back.

You may find the law as set out at the following link hard going but also helpful:

From a brief skim of it's pages it appears that the deposit should be refunded.

Thanks, Both links were informative. She is now working out some thing with the dealer and is purchasing a different car so she will not loos her deposit...

On another note, I went with her on Sunday to look at the car in mention, Very rude man, I wanted to smack him but its all sorted now. The last time I help some one out when they are not sure what they want and drag me in to there dilemma.

I'm not too sure on the legal side but from past experience, anytime I have left a deposit over the phone with a BMW dealer, it's always on the condition of seeing it in person, liking it, driving it, condition etc. I.e, that you actually go up and see the car rather than just decide to change your mind without seeing the car. Not sure if that helps but that's how I have always done dealings
