BMW Buyback (In Progress)
Hello everyone,
Im located in san fransico CA, I have had multiple problems with my vehicle... probably about 20 repairs, some issues twice, but alot of different ones.... i spoke to my dealer to do a buyback and he said he will go ahead and submit it over, so tomorrow someone from "BMW" is coming to take a look at my car (I GUESS TO APPROVE IF THERE WILL BE A BUYBACK OR NOT).... so if they do approve it, they will give me all the money back that i paid for the car, including down payment... but he said i have to pay for all of my miles, not since the first problem started..... so right now i have about 29,500 miles, i have invested probably 14 thousand so far..... do i really have to pay for "ALL" of my miles, i really thought it was only for the mileage i used before the problems all starting happening. I have had the car for about a year and 6 months...so if its around .40 cents a miles... wont i loose like $12,000?? and only get $2,000 back..... PLEASE HELP FYI, my vehicle is a lease also i have had several items repaired twice, but i dont think i have had anything repaired three times.... but overall, like i said i have had about 20 repairs.... do i still qualify to lemon the vehicle... thank you!!!!, the procedure is called,.... "BMW Buyback" i believe... Last edited by SenoritaAVA; 07-30-2008 at 11:23 AM.. |

Ok, I had a Trade Assist done about 2 and a half months ago (My car is also a lease). They did have a regional engineer come in to take a look at my vehicle, but that was for a transmission problem that I kept on having. I believe with a Buyback, that is for people who own, purchase, or finance the car. You should talk to your dealer about a trade assist. Basically, they swapped my "lemon" car (as I like to call it, never officially deemed a lemon though) for a brand new car off the lot. My "lemon" car had about 5600 miles on it and they told me I would have to pay for the mileage, but I did not have to pay for anything in the end. ( and the new car was more expensive too). I do not believe they will make you pay that much for all those miles, especially since your dealer aggreed so easily and quickly to initiate the buyback/trade assist process.
About the buyback process: from what I understand, a buyback is only if you own the vehicle, thus, BMW "buys it back from you", so then you can go buy another car from them with the money they just gave you. About the trade assist process: this is the process that I went through. Basically, BMW will offer you another car, by just swapping out the old one with a different or new one. Pretty easy for you, but a long process for them. Let me know how this is going for you and possibly I can help or answer any of your questions! Good Luck! |

its actually called a repurchase. i am going through that right now and bmw has just agreed to buy mine
in order to be considered(california) a lemon you must have a 3+ attempted repairs for the same issues withining 18 mo or 18 miles. you are very much over that so bmw may not buy back the car, instead try to work something else with you depending on your state law. i only ended up paying about 800 in depreciation and i have about 17.8k miles

I would consult with a lemon law lawyer to see what all of your rights are, then use that as a negotiating tool; the dealer may be low-balling you as their first offer by suggesting that you will owe them for all of the mileage.

crimson, so did you end up getting any $ back.... or you had to pay just to get a new car... cause i will probably get back $2,000 and then i will either re lease another car or just switch to another car manufacturer.

You shouldn't have to pay anything I think. Get a lawyer. That sounds completely shady. Being as I have an attorney on retainer lately I have answers to all odd questions like this.

Paying for mileage doesn't seem unreasonable to me. It's kinda like ordering dinner, eating 3/4 of the plate, sending it back and expecting a refund becuase the meal sucked.

nikolas, i dont want a full refund, but i want a little more because im going to have to put a whole new down payment again, for a new car..... also all the hassle i have been through, i go to the dealer at least once a month for repairs.... usually twice a month...i have probably wasted a thousand miles becasue of the problems, driving back and forth to the dealer...

My co-worker (who has 2007 335i Conv.) had a lemon car with window motor issue (3 times). BMW made it as a lemon car. So he got exact same car with 0 miles, 1 year newer version at no costs.
2007 335i conv. with some miles replaced to a brand new 2008 335i conv. was great deal. Good luck to you. I hope you get same deal (replacement).

So, the fact that he put almost 30k miles on the car should not cost him any money at all? Yeah, just get a lawyer and sue. No need for personal responsability. That is exactly the kind of thinking that make this country the capital of lawsuit in the world.

Not form BMW experience, but i have gone through a buyback on my TT. The way the process worked (with audi at least) is that they make you pay depreciation on the miles that were driven BEFORE the problem was first diagnosed. For me, the first problem started at 5k miles, by the time all was said and done the car had 24k on it, but i only had to pay depreciation on the first 5k.

To the OP, you made an assumption and is overly concerned over that assumption you made. Why don't you wait until they give you the details before you run around screaming "sky is falling".
I know that sounds blunt but you just need to calm down first and get the facts. |

similar problem with buyback
hi all, my 07 335 has had a ton of problems since I purchased it used about four months ago. the main persisting problem has been the check engine light coming and and a message coming up on the nav screen saying "engine malfunction reduce power" and then the turbos shut off.
I just took it into the dealer for the third time for this particular problem and the service manager hinted at a buyback but also spoke about them extending the warranty to 100,000 and giving me two months worth of car payments back. does anyone know much about the buyback with bmw or have any suggestions as to what I should do. I am really frustrated. Thanks... |

Sorry to hear that, that really really really sucks!
I think it's more like ordering a steak and eating 1/4 of it, all is going well and then you bite into a piece of glass. You send the steak back and they promise they got rid of the glass and that the steak is good to eat. So you trust them and then keep eating it only to find another piece of glass in the steak. So you send it back again and the same thing happens. Obviously from a "customer is king" point of view they will/should comp the steak, but do they comp the green beans and baked potato too is the question? Should they comp the whole meal or charge you for the good food that you did get?

True neither did BMW attempt to compensate for the time lost and frustration over a supposedly joyful ownership experience. How does the two balance is job of an attorney. I am going through the process right now and I agree I should pay for some depreciation but not all because the opportunity cost incurred from serving the car may or may not cover the depreciation. Should I charge my hourly rate?
