man, you must have failed business courses hard if you even went to university.

I'd almost pay a a moderator $160 to get this guy banned so he can't rip anyone else off. I HATE people like you.

You must mean try to make it 'right' ? And if so you would make it right by refunding the complete cost...not partial. Of course he did not accept, who is going to accept receiving the incorrect item...

You attempted to rationalize with the customer on the fact that brands are brands and the incorrect item you sold him is perfectly fine...

Technically, us sellers aren't supposed to ask for the 3%. If we agree on $500 for something and if you ask me to add 3% and I send you $500 anyway, you are obligated to send the item regardless. It may be a dick move, but Paypal would side with me.

In accordance with PayPal's User Agreement, under the Payments (Sending,
Receiving, and Withdrawals) Policy:

No Surcharges. Under Visa, MasterCard, Discover and American Express
regulations and the laws of several states, including California,
merchants may not charge a fee to the buyer for accepting credit card
payments (often called a "surcharge"). You agree that you will not
impose a surcharge or any other fee for accepting PayPal as payment.
This restriction does not prevent you from imposing a handling fee in
connection with the sale of goods or services, as long as the handling
fee does not operate as a surcharge (in other words, the handling fee
for transactions paid through PayPal may not be higher than the handling
fee for transactions paid through other payment methods). Sellers
residing in the United Kingdom and listing items for sale on a UK-based
website may impose a surcharge, but only under the following conditions:

1. Both the buyer and seller reside in the United Kingdom;
2. The purchase price is paid in pounds sterling;
3. The surcharge imposed by the seller is no greater than is
necessary to recover the receiving fees incurred by the seller;
4. The seller clearly indicates to the buyer prior to the buyer's
submission of a bid or (in non-auction transactions) prior to completion
of the purchase that a surcharge will be incurred and the amount of the
surcharge

In order to comply with these laws and regulations, you must remove all
mention of a fee or surcharge from your listing. You may charge a
handling fee in connection with the sale of goods or services, as long
as the handling fee does not operate as a surcharge and is not higher
than the handling fee you charge for non-PayPal transactions

Assuming your mistake was honest, in good faith, and assuming the Chinese knock off bulbs are of the exact same quality, build, and functionality and can be considered a reasonable substitute good:

I don't know what the price of bulbs are. If you let it go for super cheap and the difference between your selling price and the market price for the Philips brand is non existent or negative, the OP should not complain (if it's negative and the OP complains it can be considered restitution/unjust enrichment).

If you let it go for a fair price you should either provide a partial refund of market price less contract price or a full refund with OP's return of the bulbs.

I feel bad for both parties for having this happen, but still... caveat emptor.

The funny thing is that until the middle of page two we only had the OP's story of what happened. Then, the seller is foolish to jump in and validate everything the OP said.

Let's look at facts

Buyer says goods were not as described.
Seller states that goods were not as described
Buyer request refund
Seller refuses to give refund

Seller now has to decide if his reputation is worth $100. It doesn't appear to be.

Maybe somebody should ask the mods to post a "wall of shame" for people that were found to have been less than scrupulous in their transactions - both buyers and sellers.

instead of attacking him and us on this forum, why don't you try to work it out with the OP once more. if you can't come to a conclusion, shame on you for not disclosing brands/non oem parts.

You pay for something you didn't get and he is basically saying tough shit. I would track all his posts from here forward and bomb em with reference to this thread. I'm sorry but if you state it's a particular brand in a post you know damn well what you're putting in the box to ship out. The fact you made the mistake twice in the same deal proves you're a liar. Douche bag.

You sold the bulb for $100. You offered me $40 refund but I refused because I am NOT going to use those bulbs. And I specifically told you I will only buy them if it's mtec or philips. You assured me they were Philips so I trusted you and bought it. I asked for a refund, and you said you don't have the money so you won't.. lol
