Wouldn't have thought so - they're technically a consumable item.
3years - wish mine lasted that long!

Depends on the manufacturer warranty. Each maker and each model tire is different. Check where you bought them.

Are you implying at least 3 years on same tyres? If that's the case I'd imagine you are out of luck. Rubber perishes and lack of use won't help.

Mileage, time, rotation, make and model tire all are factors in longevity and warranty.

Unlikely, it depends how bad it is, sometimes they'll comment on just a few perishing marks which aren't an issue so that they have something to say is an advisory, possibly to get you to change them too. At 3 years old unless they looked dangerous I'd have no issue using them.

You won't get a warranty claim after 3 years.

they are slitting between the treads only the fronts.. bmw just told me depends on driving style she drives like miss daisy I drive mine much harder and they aren't slitting and are five years old mind you they are Pirelli not shit bridestones same make that used to wear out prematurely on the 335's I was told that was my fault for not keeping the correct pressure despite keeping it spot on again no problems with pirelli

It's on the sidewall that is the real problem. It wouldn't bother me and I'd keep using them. Maybe change the full set once the rears are dead.

I had a trailer tyre blow the other day is about 12 years old and was perished but not much worse than the tyre on the bmw so not risking it!

That would be significantly worse internally I'd imagine.

Get real non run flat tires. Best upgrade you can do for the car.

To fail the MOT the cracks have to penetrate to the ply or cords. So shallow surface cracks are not a MOT fail.

Aside from that, I'm surprised the tyres have worn out at such a relatively low mileage, especially for a low powered, gently driven car. Are the pressure always as per BMW recommendation? So many drivers complain about the harsh ride and attempt to solve the problem by reducing pressures - not a good idea. Low pressure equals overheating, which equals reduced life and worse handling.

And so many drivers don't check the pressures as often as they should, or change them as the load varies. Perhaps that's part, if not all, of the problem.

Step 1
Remove run flats

Step 2
Burn them like a black hawk down Somalian

Step 3
Install a quality non run flat tire

Step 4
Enjoy the new ride as a mob of angry skinnies decends on you.

I think the point is the OP's daughter doesn't want to buy 4 new tyres.
