I do agree that the M-sport is a great value, and if becomes available WITH the aero kit in the next month or so, I will order it that way. (I'm not holding my breath.) If not I will just order it with the aero kit.

You need to get your terminology right.

Aero Kit has been available in the US since E92's introduction and you can get it. If you didn't your dealer screwed up!

M-Sport / M-Tech has not been avail in the US w/ E92's until the new announcement is made and we still don't know when it will be available. But M-Sport Pack is what we are talking about in here

Aero kit and M-Sport two different things (do a search). Your dealer can't allow you to order M-Sport back in 2008 and as of today you still can not order a 2009 MY with M-Sport. It sounds like you keep ordering the Aero Pack and not getting it for some reason.

Wrong. The aero kit for the LCI '09 E90 is not yet available in the US. Period. It shows as an option on the web site, and you can order it from your dealer. But there are no parts for it in the US as the vendor has not supplied them yet.

Yes it has been available since the E92's introduction and I already have it (factory ordered) on my '08 (pre-LCI) 335xi. But the new Aero kit for the '09 E90 is totally different from previous years and is not available.

I also know for a fact (directly from the prep center in NJ) that they are test fitting the first LCI M-Aero in a coupe of weeks. As I said, the dealer ordered my '09 and when it arrived at the port (it is a port installed option) there was no kit available. This was BMW's screw up. They allowed a car to be ordered for which they didn't have the parts.
