i don't know, driving my 330i for a week now, i can tell you i hate the CDV from the bottom of my heart. if i can drive a 30-year old Skoda or a 20-year old Ford truck with no problems, howcome i only get 1 out 10 smooth shifts in my E90. f-ing CDV! i'm literally embarrassed to give someone a ride because i can already hear comments like "oh, he got a new BMW and can't even drive it. my civic drives better than this."

damn warranty. i'd replace it on the spot otherwise!

I'm sorry,... but I'm completely lost on this thread/topic.

The clutch in the e90 is just fine, CDV or no CDV. My wife has been driving for 10 years, and had never driven a 6-speed before, not once! It took her three weeks of after-work & weekend practice; but she's shifting like a pro.

In fact, due to the pretty precise engine response to the throttle of the BMW I-6es, I find them very easy to shift smoothly despite CDV. An Audi Turbo Diesel is far more difficult to shift smoothly....

Donno ....
I had read somewhere that the euro cars may not come with CDV's?

Haha, I wouldn't worry about the warranty. They don't even have the CDV part in the ETK. Since no damage would result from taking out the CDV and your not altering with an aftermarket part then there is no worry IMO.
