To the OP;
1) So after everything I've gathered, You asked the dealer to check on 2 issues for you which ended up being the two $175 charges for diagnostics, which totaled 350$. Im not sure why they charged you two different diagnostic fees, but they were charged on 2 separate days per your invoice, 10/19/18 and 10/23/18. The battery debacle made up the rest of the $917.78. Fortunately, the dealer removed the battery cable charge which was good. 2) It seems they did quite a bit of recall work for you. I personally don't know if the clogged cats in question are recall items, but per your invoice, they did not replace them. It mentions them being clogged, but it did not state that they were replaced unless they are integrated into your new exhaust manifold (which I'm pretty sure that they are not). 3) As far as your SES light still being on, that could mean: a) You have a completely unrelated issue, which has nothing to do with any recall, per your original complaints. This issue is still unfixed because only warranty work was performed hence, the SES light still being on. b) Your cats are still clogged because they never replaced them, unless they are integrated. Perhaps that is giving you a SES light. In conclusion, now that the recall work is done, you should: A) Check with BMW to see if replacing that clogged catalytic converter would be covered under warranty. If it is, have them perform the work. Then, If your SES light is still on, something else is up and you should follow up with BMW since your O2 sensors were in fact replaced by them. B) Have your Indy mechanic look into your original inquiries if nothing has changed after you replace those Cats. C) Don't lose your cool at the dealer, just take a breath and relax, then say what you need to say. And look, I know the battery thing is questionable, but they removed the charge. No need to try to sue them. You could try to recoup the cost of the rental if that would maybe make you feel better about all this... I do wish you the best of luck OP, I hope you get all this straightened out. FWIW, the battery cable was part of a recall for my e90, and the dealer performed it at no cost to me. I'm a m3 so I'm not sure about 328 recalls but once again, check with the dealer. Last edited by srmast1; 11-17-2018 at 04:06 AM.. |

This is what I love about OP:
"Everything that I say is true, everything that the dealership says is false. Therefore, I am right." Can you imagine working with this person? |

Jammer, I have been working with him since 10/31, as have we all. I suggest OP open a go fund me page so we can all send him some money for his pain and suffering in this debacle. But who will pay us for ours?

Seriously, 7 frickin' pages? WTF?
This is turning into an OCI/oil-type thread...

I feel as if there is some misunderstanding that is occurring and leading to OP's frustration, or he/she is still extremely angry about the battery cable thing and the strange call log stuff that followed. One way or the other, just gotta let that stuff go because the dealer rectified the situation. I don't see any grounds for legal action on OP's part. |

Damn, OP, give it a rest. You have no idea if the dealership lied. Did you personally perform a polygraph test on everyone there? Did they admit to you that, yes, they lied? You sound like an idiot. Dealership could've called the wrong phone #, put the work on your invoice by mistake, etc. Showing us phone records is ridiculous.
You have yet to show anyone evidence those parts were even replaced. You've been asked multiple times to show proof that work was even done. Most importantly, even if the work was done, YOU GOT IT DONE FOR FREE. Unsubbing at this point. I think we're all being trolled. Nobody is this stupid (are they?).

He had 2 different issues.
There are diagnostic fees for each issue. Quote:
I’ve had them played when I told a GM of the Dealership what a nightmare I went through on their phone tree. Who’s to say they called you at that number? Most Dealerships have multiple contact numbers. Home, work, mobile, wife etc. Last edited by IK6SPEED; 11-17-2018 at 04:02 PM.. |

On 2 different issues that are non-specific as the OPs were, time was spent on both. That is standard at most every auto shop. If you went in for 1) car occasionally running rough and 2) the NAV would occasionally go dark , would you not expect to be charged for both unrelated issues? |

Many indies around here will refund the diagnostic fees if you get the repair done as well. |

If you have specific issue instead of what OP stated when dropping off they are more forgiving. And yes, Indies are more forgiving. Of course no one has mentioned that OP was given free loaner for 12 days on a 10 year old car. |

If I was a moderator this thread would have been deleted weeks ago.
OP should buy a D+K can cable and learn how to code his car instead of flaming on the internet. |

At the end of the day if the dealer did work that OP didn't authorize, and they claim they did have his authorization, that is a major issue.
Luckily I have found a solution.... Don't take your car to dealerships!
