Hit and Run North Plainfield NJ

Hey everyone,

My friends sister was hit by a minivan while crossing the street Sunday afternoon. Luckily, she's ok since the minivan was not going too fast (the driver was making a left turn at a traffic light and was trying to beat a bus that was pulling out of a bus stop) The driver stopped, got out and asked if she was ok. According to witnesses the driver panicked, got back into her car a sped away. The driver is described as being a Hispanic female driving a gray or silver minivan (possibly a Nissan minivan). This occurred on the corner of Mountain ave and Watchung ave in North Plainfield.

I know this is a long shot but if anyone knows anything please PM me.

She went to the hospital overnight and a police report was filed.

If she had alcohol in her system, in the state of NJ, it's better to get convicted for a hit and run rather than a DWI. The court can't prove the driver was intoxicated if they don't breathalyser her at the scene of the accident.

Or she was an illegal...

In NJ, a DUI is a traffic violation. A hit and run is aggravated assault (where bodily injury is involved with the victim.) It's way better to get convicted for a DUI than a hit and run.

A DUI and a DWI is different.

And you will most likely getting other tickets in addition to a DWI. So if you do a hit and run, you take the DWI out of the equation.

In NJ, the law makes no distinction between DUI and DWI. It's true that getting convicted with a DUI/DWI charge will result in extensive fines, DMV surcharges, possible license suspension and incarceration (depending on blood alcohol level), a DUI/DWI is still resolved as a traffic violation while a hit and run offense will result in a much more serious conviction.

In NJ, the court system is extremely aggressive with felony hit and run violations (hit and runs that result in either injury or death to the victim.) NJ also has no provisions for lighter sentencing of first time felony hit and run offenders. As a result, you'll receive stiffer punishments that include likely jail-time, extensive fines and longer term residual damages than you would with a DUI/DWI, such as increased insurance premiums, longer term loss of license, etc.

You're much better off with a DUI/DWI conviction.

All I know is this is more and more prevalent nowadays:
no license
revoked license
warrants
NO INSURANCE
ILLEGAL in the country

Its crazy out there, and that area is a hotbed for hit and runs. Having lived within 15 minutes I hear all too often about it.

Glad she is OK, sucks b/c there are 100,000 Nissan Quest minivans running around that area.
