The only way this is legit is if you ISP ratted you out, most all ISP will not tell the content owners who is using what IP address, so if your ISP did not rat you our that mean your company or school ratted you out, I am assumming it was not your company since they would have fired you if they got one of those request for user information. So this leaves a school, and only a few college are ratting out their students when one of those letters come.

If your school ratted you out there is little you can do to hid, since most schools require you to authenticate on their networks so you can not claim someone using your open wireless connection.

The content owners do no not want you to go to court since they have to prove it was you and they also have to prove damages and both of those are hard to do in these cases that is why you're not seeing any case where they take people to court. However, most people getting these letter are paying since it cost far less than the $25K to $50K retainer fee you have to pay a lawyer to even look at your case since any good lawyer knows it going to be a long drag out battle with the content owner.

it was through a home isp. I was under the impression your isp had to inform you if someone is requesting your records. No such notice was sent, which leads to the virus/phishing scam. Paper shredders are very helpful in case anyone was wondering

Different ISP have different rules on this, some basically tell the requester of the information to get a court order to provide the specific user information behind a specific IP address since they have to protect your privacy. From what I know courts recently have not been too incline to grant a order of disclosure for the content owners so they can go on a witch hunt. They can no longer go to the courts with a request for joe doe using "www.xxx.yyy.zzz" IP address.

Because of this RIAA and the MPAA have focused their attention on IP which originate from schools, colleges & universities and companies since in all those places you have no privacy protection and many of those place make you agree to a code of conduct and if they are violate then they come after you.

The other question is did the this request come via register mail and was it served on you or did it come some other method. It is not valid unless it was actually served on you, since there is no other proof you have been made aware of this.

Trust me if the RIAA or MPAA was after you, you would know it. and they would follow all proper procedure to ensure their claim holds water. They would have provide you specific about the file, the time period, and all the particular about your computers like MAC and IP Address and any other information they would have about you and how they got is, like your ISP ratted them out them, and if they happen you need to contact your ISP and find out why they ratted you out.

Check out the law firm, see if they are real, recently there has been scams of people getting letter and phone calls from law firms claiming they represent some company or credit holder and they threaten people into paying for bills or moneys they never owned.

If you do a reverse look up on the phone number it will tell you if it is registered to a company or a law firm you can also search the web for the law firm to see what comes up. I had a number calling my house all the time with no caller id when I did a search on the number found it was link to some scam like I described above.
