Try cleaning the Vanos solenoids. Which scanner are you using?

I'd be testing the wiring harness for the coil and injector on cyl 4 back to the DME. Make sure all the earths are good also.

Not sure what tools you have available but one way to test for spark if you don't have proper testing equipment is by unplugging and removing the coil from cyl 4, plug it back in and put one of your old s/plugs in the coil, earth the spark plug with a good earth wire and and start the engine. Check to see if you have spark.

Use a scanner with live data to see the misfire rate. Is it just misfiring frequently, or not firing at all?
Use an inline spark tester between the coil and plug to make sure it's getting spark.
Use a noid light to make sure the injector is getting the firing signal.

If you're in one of the states that covered under California emission state law your SULEV n51 covered until 150000/15 years. I don't have the exact list for what parts are covered for e90 but I have one for e46 so they should be the same. So maybe you can just go to dealership so they can tell you if it's covered
