No MOT = No Insurance ?

Had a bump with someone this morning, exchanged details ect.. and went off to work. Thought I would check his car to see if it's all legal and turns out that this MOT expired over a month ago

I need a new mirror and the wing needs a bit of attention, I would say no more than £400 to put everything right. His was far worse so I got the impression he want to go down the insurance route.

Question I have got here is, will his insurance still be valid ? He's with AXA by the way.

I'm pretty certain that means their insurance is invalid....

Insurance is based on (amongst other things) a roadworthy vehicle, if said vehicle does not have MOT to confirm that then the insurance is invalid. That said, I'm not sure how that would work with them making a claim against your insurance....

In this situation i believe his insurance are obliged to pay for damages & then will try to recover the costs from him directly.

You should be fine but i'm not so sure about him.

He's fluffed, bad day for him for sure. Did he attempt to settle outside of insurance or was it just a case of swapping details?
