Reckless Driving Citation (Roosevelt Blvd)

So tonight my cousin and I were driving back from getting his e90 M3 tinted. We were driving down Roosevelt Blvd. heading towards I-76 (Philadelphia PA).

The car isn't even broken in yet and he refuses to drive aggressively at all until the 1k service is done. So we are driving along at about 50mph (40mph zone) and traffic is relatively thin. We approach a cluster of 3-4 cars and my cousin moves into the center lane to take the only gap available; he goes to the right lane, around a car going slow in the center (it may have been a bit of a tight squeeze, there was a car in the right lane but we made it fine) and back into the center lane. He did use his turn signals for each lane change. Gives it a little throttle here, might have reached 60mph. 1/4 mi down the road we see the red/blue lights o' death.

Sidenote- the officer was immediately a dick, and even forced us to pull the car UP a curb and onto the grassy median.

He cites my cousin with reckless driving, court date in early January. Anyone have any suggestions/tips on what angle he could take here? The obvious issue is insurance rates which, assuming they don't drop him altogether, will surely skyrocket. Write-in plea? Try to get it reduced to speeding, disobeying traffic control device?

Ps- the officer wrote the court date as 1/12/2008 which is obviously a year off. I don't suppose this voids the citation?

An NYPD buddy of mine stated,it always best to hire a lawyer for NYPD summons, if not, you can try stating that there are errors in the issuance of the summons and you would like it to be dismissed, believe it or not I've seen those dismissed .

The error was made in the summons by the issuing officer,that might be able to dismiss it .

yea. my friend got a ticket from the day before. it was 10/29, it says 10/28. big mistake on the cops part but i dont know how he'll prove it. it happened in rockville center, so idk how he'll fix it

Well your friend got caught in the step up enforcement on Roosevelt Blvd. They been advertising they will be cracking down on people. They have zero tolerance these days on Roosevelt Blvd, I even saw they have their police force now, they call themselves expressway police which is different than the normal Philly police.

The biggest problem your friend has is he will have to deal with Philly traffic court which is tough, the officer is not required to show at the first hearing. These are real judges not magistrates that exist in the courts in the suburbs.

Also errors on the ticket is allowed in PA no reason for dismissal unless it is related to what the ticket was given.

Fight the ticket, when he takes it to court the judge will ask him if he is guilty or not. He should plead not guilty and he will then be asked why. I fought a ticket for speeding and reckless driving. I pleaded not guilty for reckless and pleaded guilty for speeding. I was still guilty so I had to pay the fine for speeding only and the charges for reckless driving were dismissed. Good-luck to your cousin!

Get a lawyer, a friend of mine got the same ticket on the blvd no points but he paid out the assssss. oh yeah he was racing..

ur prob gonna get cleared to some lesser charges that will cost $$$, or you'll be able to plead to speeding...wreckless driving tickets in NY are a nightmare now i heard you can get your license suspended but idk about PA.

but just plead they always bargain down its all about the $
