If everything has failed as in reasoning with him and get him to refund you,
get the money back from paypal or you credit card, then you're left with one thing. I suggest you take him to the MD small claims court for fraud (since you ordered the tires over the Internet, I believe MD court has jurisdiction) and teach him a lesson since he knowingly defrauded you. The fee is some very small amount but you would probably have to send the refund back (you wouldn't want to appear as if you accepted the $100 as settlement) and maybe the tires (after taking accurate pictures and documenting their state). He has dug a hole for himself with his e-mail response in which case I think it's worth the try. Dishonest people like him need to be taught a lesson. If not for a full refund, I would take him to small claims court for pure satisfaction to have a decision in your favor and if you win and he doesn't pay, he will be in shitloads of trouble. If he is smart, he will pay up and he won't let things go that far. Otherwise a collection agency will be after his ass. And if he still doesn't pay, then the law has more surprises in store for him ;-) So how far are you prepared to go? That's the question. Personally I would nail his ass since he was dishonest from the looks of his e-mail response to you, he knowingly defrauded you and misrepresented the state of his tires. |

I am so sorry to read this bud, I hope the CC can help you out, I agree the guy totally ripped you off, he completely misrepresented the product and should be totally responsible for a full refund!! This is the exact reason i never buy from members with such a low post count...

Good news!!!
First, thanks for all in this forum for sharing their opinion and providing support and advice on this situation. Next, thanks to Eyejammy for reconsidering. Eyejammy has sent me a refund. This matter is closed. I got new tires from the tirerack and I should have them installed by the weekend.
