just had a letter today ill write it out word for word to let you read it
FINAL NOTICE,
Dear MR >>>>>>>
We notice from our records that the previous two parking charge notices we have sent you,which refer to the breach of terms and conditions for parking at the barnstaple retail park on 18th september 2010,have not been paid.
as you will notice the reduced parkig charge amount of £50 has expired.The amount now payable is £80.
If the payment of £80 is not fothcoming by 19/10/2010 this will see the prking charge rise further to £110.
If this letter is ignored,we will have no option other than to instruct our debt collection agency, to secure immediate payment,commencing court proceedings,through our solicitors,if required.Therefore to avoid future and unnecessary action,please paye outstanding parking charge at the final reduced amount,for what was a clear contravention of the aprking regulatios.
The consequences of not paying,and subsequent legal proceedings,are that you ould receive a COUNTY COURT Judgement and,if you ignore that,a bailiff will attend your address to remove goods.
We are determined to potect the interests of our clients and their customers by managing their car parks,as is legally their right,so that they are free from parking abuse of this kind and fi fot their intended purpose,

as you can see from the letter there is a lot of big words that would scare alot of people,what would you do

i am currently anticipating these letters and to be brutally honest with you that is quite a scary letter..

and the end of the day if they do take you to court which is so so so so unlikely, the following will/can happen:

* they can only claim for the amount of revenue lost.. not this extortionate amount
* you MIGHT get a ccj, but if you pay that within 28 days it won't affect your credit anyway so that's no biggie (so long as you apply to get it removed!)

i know it's hard to do, and i'm going to struggle to it myself.. but ignore ignore ignore..

maybe im becoming a push over but i would just pay it. The worry it seems to be causing you is worth £50 quid to get rid of it IMO.
If you dont have the balls to see it through then let someone else when they get caught.

Many of us have had the balls to see it through, if its not from the council or police then the answer is simply dont pay it. its tantamount to anyone sticking a ticket on your windscreen saying you owe me x amount. Any of us could do that.

AFAIK nobody in the UK has ever been to a court as a result.
With the amount of people who DO pay, and the almost im[possible likelyhood of securing a tiny amount from a small claims court, they won't ever bother.

There has been a fairly high profile court case recently. But in that one the driver got into correspondence with the enforcement company. There have been other court actions:

Serve them with a section 7 under the data protection act 1998. It gives you access to all of the data(info) of you/your vehicle, held by the company. See what evidence they have. Remember they always have to go to court before they can send any debt collectors / bailiffs to you home.
