Angry EPA may hold certain 09 models until 10/24???

Man, WTF?!?

This is completely contradicted by my CA, who just e-mailed me today to inform me that my 335i is being loaded on to a truck this morning should be headed to Norcal as I type. So confusing...

The EPA has not granted certificates to several of the 2009 models as of yet. CARB has also not certified a variety of models and may delay the 10/13 pickup date for 2009 MY vehicles as we had originally been informed and expressed to you.

The following should be CARB certified by the end of the week: X5 xDrive30i, X5 xDrive48i, X6 xDrive50i, 550i and 650i.

The EPA has not certified the following models as of today: X6 xDrive35i, 135i, 335i and 535i and are not expected to pass the CARB requirements until around the 24th. These models may be delayed being sent to dealers due to these certification hold ups.

These are the only models being held at this time. 2009 LCI E90 328s have already hit several dealers today and should be in the hands of owners shortly.

We will keep you updated as we hear more.

I love how CAs just regurgitate canned answers for 90% of questions.

Everyone is posting that their CA told them their car is on the way..

My CA told me yesterday his internet was done and he would get back to me. No response yet. I guess that's the other 10%.

I question the reliability of this information...

1. Why would they hold up 335i's? It's not like it a new engine? I could see maybe the 335D but why the 335i?

2. Why would BMWNA not tell the dealers? My CA seems to think my car should be at the dealer on Saturday. (until he read bimmerfile)

3. Why 10/24? It shouldn't take them that long to certify an engine that is unchanged from MY2008.

So in closing, WTF!!!!

There are reports that some components of the N54 drivetrain have been changed in MY 2009 to address issues with the previous design (wastegate rattle, 29.2/turbo lag, et al.). I would think these changes would be minor, but it may be that they are sufficiently related to emissions to prompt the EPA to require recertification.

If this IS the case, our cars better not have lag issues!!! Does anyone know where this info is comming from? Official? Rumor? Speculation? Hear say? BS? OK, I'll stop...

i'm not sure how much weight there is to this claim but my ca swears it's a ploy to keep '09 turbo'ed bmws off the lot in order to sell off the remaining '08s. like all other cas, he has not heard anything regarding the holdup...hmm.

More Questions Than Answers

I'm getting 3 different answers from 3 different sources.

My CA here in HI (who is off today) swears he has not heard anything regarding an EPA hold. Of course, I have been 2 steps ahead of him tracking my car the whole way, so take it for what it is worth. He did confirm that the dealership here has not received any new 2009s (of any model), but we are also 2 weeks behind the mainland in delivery, so that is probably meaningless. He says he will call the VPC when he gets in tomorrow and find out what the real deal is.

The customer rep for Waggoner in Oxnard, CA, told me that no 2009 335s are are being loaded right now. He could not say for certain why.

A family friend who works at a dealership in Colorado says that that they expect some of the first 2009s over the weekend and that they are not aware of a current hold. He is going to make some calls as well.

Who to believe? All I know for sure is that I'm going to be extremely angry if I miss out on the BMW financing offers that only run through October 31 because my car is stuck in CA until Oct 24. I have to believe that is a "worst case" date if it is true.

though i do not expect my car until november.. i feel your pain guys.. its only been a week for me since i placed my order and i'm going slighty manic.. the car seriously dwells on my every waking thought.. this isn't healthy.. i really hope the EPA sorts this out soon to prevent further delays.. for your sake.. and for mine (i really hope this doesn't affect my delivery)

I forgot to add one thing my CA said when he told me that all 09's were being held till all the 08's were transported to the dealers. He also said they may be holding the 09's till they sell or clear many of the 08's from the dealerships. He said I've seen this happen before .Now who is lying .BMW would take a lot of complaints from all of us who are pissed about this if they were holding our 09's to have more time to clear the 08's. But now they can pass the buck and blame the EPA. Hows that for a theory or are they just driving me nuts . waiting. jamo

should I forgo the new idrive and try to find an 08 with my options?

It's funny because I would be driving an 08 already if my CA had been responsive enough to tell me the cutoff for ordering 08s.

I feel your pain, SD. I was in the dealership in July with money to spend on an '08, but here in Honolulu the dealer has no allocations for (a) manual transmissions and (b) xDrive models, and they couldn't find anyone with an allocation that wasn't already in production to trade with to get me what I want. So, I wound up having to put a large (non-refundable) deposit down on a 2009 at the end of July to get the dealer to convert a 2009 allocation to manual/xDrive. My CA is not exactly the most attentive guy (none of them on the island seem to be), so this has been a comedy of misinformation from the get-go, and I know I won't get my deposit back without a fight. If I'd known I was going to have to wait this long for delivery, I'd have gone with the ED option. At least I'd have been able to drive the car.

As an aside, the 2009 MINIs had the same problem at the end of September (see NAM forum). They were told there would be a 2-3 week delay, but their cars started to clear in about 1 week. If we all think positive thoughts, maybe we'll get lucky too.

Oh, well. I'll quit whining now. My car will be here someday.
