the OP was provided advice regarding the major leak, if I had to guess a leak from both the engine valve cover gasket and the oil filter housing, both pretty common. The Oil may have (speculating) leaked on to the belt and caused it to slip and snap in the drive train.

The root of the case was the "Leak" not the belt, had the leak been addressed as advised by the tech, the end result would not have happened.

Best method is to contact BMW NA, explain the situation and that you are very unhappy that their product did not last the intended 50k miles, and you are requesting that BMW cover the damage. Be nice about it. They may help you out.

Otherwise, contact the Insurance company and see if you can do another course of action. 15k for a engine is way too much and for that you can buy a totaled m3 and do a transplant :P
You assume that the cause of the failure is lack of oil. I agree that driving with low to no oil is a bad idea. But he was told that his leak was small and should make it about month. The OP also makes no mention of low oil lights. He also states that the failure of his engine was diagnosed to be a belt being sucked into his engine and not oil starvation.

And yes I know that the problem with the serpentine belt is attributed to the engine mounts.

We're all making hypotheses based on limited information. The final diagnosis will be made at a later date. That is the day when you might be able to shout "I told you". if it matters that much to you. Lol

Why in the hell would BMW throw him a bone and repair it on their dime regardless of the milage ? He was informed about the valve cover gasket leak and didn't have it repaired. But the #1 issue is he is way out of warranty, his car is an 07. They are NOT REQUIRED TO PAY FOR SHIT.

Are you asking if committing fraud is a good option?

I don't recommend it. I think your better recourse would be to sue the dealer for giving you bad technical advise with this being the foreseeable harm.

You would be surprised how often BMW steps in when something is below the intended bumper to bumper warranty.

When turbos were failing out of warranty BMW sometimes would cover labor or parts or sometimes even both.

We don't know what was said between the sa and the op so it's possible the sa said he could wait, which appears to be against the tech recommendation. If in the op shoes I would reach out to BMW na.

I think the biggest problem here is that it states customer says only do oil change will do leak later.

Which leads me to believe you made the deciding factor in neglecting the car and that they actually recommend you fix the gasket.
You can look at that another way. There's nothing indicating they advised customer of any risk of waiting.

Edit: just read invoice. Forget all that.

Car in service date is 10/2008, I always forget this, it's 5 or 4 years warranty? If its 4 years his warranty just ran out but it looks like he was charged for oil change etc which leads me to believe the car was a salvage.

That's a good catch. According to that service sheet, your car was brought in within the 4-year in service date AND with less than 50K on the odometer. It should have still had the full 4yr/50K factory warranty on it when it was brought in on 9/28/12, yet you're getting charged for everything including the oil change.

What gives?

I was doing oil changes at a car x almost every other month because I had the oil leak it turns out. The last one as the paper shows I went to the dealer to do the oil change and get a diagnosis and they noted the oil leak.

Looks like you bought the car used, 3/2011. Were you aware of the in service date? Your dealership took you for a ride.

Just because a car is an 07 if it is sold in 08 the warranty starts in 08 when it first hits the road with its first owner.

Check local junk yards but IMO you should reach out to BMW NA at the same times.

If not that dealership defrauded you by not honoring warranty work based on the in service date.

The dealership seems shady go to another dealership. And I would ask for my money back on the warranty work for the oil change and diagnostic you also have a case for BMW na because you can argue that the service advisor never referenced the fact that you still had warranty on the car and that repairs should have been preformed at no cost to you and also you can argue the fact that the car failed 2 weeks after warranty expired CALL BMW NA

I both the car from this same dealer. Says on that invoice the date it was sold to me

Ok well they didn't honor their warranty. Regardless the in service date is the first day the first owner is handed the keys and the car drives off the lot

Was your car a cpo?

First owner: 2008
Second owner: 2011
Factory warrany valid regardless of who the owner is warranty follows the car vin: 2012
Car manufactured: 2007

Your dealership ripped you off on work that should have been warranty I rest my case.
