They cant deny service without a cause. They need to PROVE that the procede caused the pump failure. Go back in and ask them for proof. Or go to another dealer, you should only be flagged at that dealer. (???)
Dealerships around here dont care, You really should have taken the procede out when you went it for the fuel pump. They wouldnt have cared about the intake, plus how can an intake cause a fuel pump failure when its running more efficent? |

try. and try again. it will work. best of luck.
And: do not tell people you voided the warranty and then ask for warranty work.....

This is They cannot void your warranty unless your mods caused damage. They cannot just void it.
They should replace your fuel pump because it was a recall anyway. I don't know....try to push more and mention a lawyer. Look up your California laws and see if you can do anything about it.

Not another one! That sucks man, because BMW knows their fuel pumps are shit. Did the dealer seem like he was on your side at all?
GL.. scares the hell outta me.

sorry to hear neema. honestly doesnt always get u what u want. remember dealers are likely dishonest too.
take that shit out completely and go to another dealer. fuck their flag. if ur car is clean they cant say shit. if they say it's flagged say it's coz of wheels/drop and cosmetic shit the other dealer "assumed" u have more mods |

Its illeagal to "VOID" a warranty. All they can do is deny service. You definitly need to back in and argue a litte and not get pushed around. They will back down.
They must prove your procede caused the damage, if they cant then tough shit, they will have to fix it. I still dont get why you didnt take it out since you were going in for a pretty big issue. A fuel pump is not a small minor issue. Make friends with an SA, honestly thats what you should have done in the first place. Thats what we all should do so we dont ever get cornered. When you go in for service give an SA $20 or something and tell him lunch is on you. ALways take the car to the same SA, youd be surprised how far this would go. |

There is however a nice little term called pattern of failure, and in this case a fuel pump EASILY falls into this category and should be replaced without PROOF that the mods caused it to fail where it otherwise would not.

sucks bro. like everyone else said. be aggressive. hold your nuts in your hand and go in there cussing and yelling if you have to. Mention a lawyer, if u have a friend or family member thats a lawyer throw his name out and talk to him to give them a call. it'll rattle their balls. they'd rather do a $500 repair than fk with lawyer fees and the bad press.
PS take the procede out first. not the intake. so they think the intake was the mod which is harmless.

Well, it may not help much, but you sure provided valuable information for the rest of us here. We now have a better idea of what we are up against, although I can honestly say I am not surprised.
Who knows; with everything going on, we may see much more of this happening. All I can offer is get your car fixed and enjoy it! |

This is b.s.
Among other things (like threatening to get a lawyer) you should complain to NHTSA about this. They already have a file open on the 335i fuel pump failure. If enough people complain and point out that this failure put their safety at risk, NHTSA can force BMW to make this a mandatory recall (vs. voluntary). BMW has to pay for mandatory recalls, even retroactively and even if your warranty is voided, so save your bill if you do get stuck with it.
