102 in a 65 on I88 Near Rockford
My wife got a ticket on I88 near Rockford. The Cop was not happy. I am a little worried for her. 102 in a 65. She has to appear in court in March. I heard over 40 is reckless driving but it seems like that might have changed recently. Anyone in Illinois deal with this before? Should I get a lawyer for her or is she just going to end up paying a lot of $ and probation? She is freaking out so any advice would be really appreciated.

She definitely needs legal counsel. She also needs some common sense. Smh. Wtf was she thinking.

I dont know she is usually great. I think in the 14 years we have been married she only has had 2 tickets. Her speedometer is broken and I know that's not a good excuse but she is a good person who for some reason did something stupid. I really need some help and advice. Should I call a Lawyer? She is 37 and 2 tickets on her record in 20 years. SHe has seriously been in tears since it happen. I dont want to tell her things will be alright when they might not.

lawyer up...or at least consult one. Her good record should help but that's alot over.
Comfort her. Its not like she is going to serve 5-10. It may cost some and she may lose her license for a bit but you'll make it work.

I truly think that you should look into talking to a lawyer. In Illinois anything that is 40miles and over the speed limit is considered an "Aggravated Speeding " offense which is a criminal offense (class a misdemeanor). Due to the possibility of it being on her criminal record and having a high fine, I would highly recommend you talk to a lawyer.

Lawyer up.....Right away. Call a guy named Bob Stringini, he is out of Addison. He will probably refer you to someone out there that is friendly with the judges. It will cost you $1500 to have a lawyer represent you for a Class A misdemeanor, but with her good record and a lawyer that knows the judge, you may just have to pay the fine and get supervision. Don't mess around with this, because this ticket carries the same weight as a DUI on your record. I know from experience. You do not want this going on her record, because the recommended sentence is something silly like 6 months in jail with a 1 year suspension after that. The prosecutor will try and nail her to the cross if she doesn't have good representation.

Buddy just got the same thing. Hes 18 and nothing happened to him. Fines and court costs and driving school. Good 6-700 dollar learned. He had priors a year before that. He didnt even contact a lawyer. I would not lawyer up for this. You could extend your court date a few times and go from there. I remember i did this and i got screwed on court costs when it changed from like 50 bucks to like 150

Wouldn't she be responsible for more court costs if this gets dragged out by asking for continuances?
Also, there are other costs involved with the ticket if she gets a conviction. Insurance will go up because of it, and will go even higher if her license is suspended. If her license is suspended, they may be paying for a car that ins't being driven. Is he going to drive her to work? If not, she's gonna be buying more shoes because she's wearing out her heals walking so much. At the least, he should consult an attorney to decide what she is looking at. Nick

When I was 16 I got a ticket going 84-45 and is all I had to do was pay a $500+ ticket. Didn't have to see a judge or anything but I live in CA. I know every state is different. That really sucks that they are making her see a judge. Hopefully you get a nice judge that lets your wife off easy! I don't think you'll need a lawyer but def never hurts just in case. Just sucks to pay for one.

With all due respect to all who posted what happened to them or their friends here, how recently was that. I know the cali dude qualified his statement but the IL law recently changed to become more stringent towards speeding and therefore your story may not be applicable.
With a clean record, I would think she would be fine but in no way would I take a chance without an attorney but he's a big boy/she's a big girl. Obviously, she was very concerned and given that I wouldn't leave any possiblity unaddressed.

I was shocked when I heard about it because I routinely hit 80+ on 88, which is a 55 (meaning flow of traffic is about 80), so if I'm not paying attention, I can get pretty close to that magical 31 MPH mark without noticing....
I can't believe how fast the flow of traffic is on some of the freeways and especially tollways around here. That 31 MPH mark is awfully close to the current left lane flow in a lot of places. Sucks. Gotta up my situational awareness now. Anyway, good luck OP. Even though your wife wasn't 40+ over, she's still facing a misdemeanor. I bet if you fight it, with her record, you will get the criminal portion dropped as long as you've got representation. That's just MHO though. 102 is pretty high, 3MPH less would have looked much better on paper. 7MPH less would have been stellar. |

My 110 in a 55 looked impressive to me because a mile before that, I was doing 145. That was 3 years ago, Dupage County, on 355 Southbound at the 88 exit ramp. When I got mine, the ticket carried the same weight as a DUI. Now they are stiffer on penalties, all around. I got lucky, I lawyered up, went before the judge. He asked what I was driving, I told him, and he thanked me for not doing it in a Camaro or Mustang. I said "I'm sorry, I was stupid", and he told my lawyer he would see him on the golf course that weekend. Either way, the OP needs to retain a lawyer, because they are out of their area. Whiteside County only has 58000 residents as of the 2010 census. The median household income is $40300. Trust me, the courts will see this as a good way to generate good revenue and make an example from a "city-slicker" if she doesn't have a "friend in the courts".
To the posters who have mentioned she should lose her license, or the like....you know damn well everyone has done it at least once. We don't buy performance cars to go 55-65. It was the wrong place, wrong time, and she just happened to get caught. Was she breaking the law, yes. Was she paying attention to the road and traffic, most likely or there would have been other tickets also. At least she wasn't drunk, observed racing in and out of traffic, or caused an accident. Don't pass judgment on someone for doing something you are guilty of also. Nick
