So let's open up another can of worms here. This was an e-mail I just got from my SM when I wrote in and asked if they got v31.

"I got a 32.0 upgrade. I just want to make sure it works first"

I hate to say this but there are only a few people who I even trust on this fucking forum...too many noobs with changing stories and stupid questions. There are a few who have been here since the get-go and I'm sure there are people who have come lately that truly have the lag, but, I think I am going to start PM'ing the only ones I trust from now on...too many kiddies and who the fuck knows who the BMW moles are...

It might not be the "noobs" and people changing storys.

It can be the DEALERS being the noob and perhabs maybe BMW NA isnt telling the dealers the truth or trying to avoid it most as possible.

Read what the dealer wrote on my invoice. Seems like they had NO IDEA what is the new version that causes no lag or fixes the lag.

From what i see from what they stated. My car being a 05/08 build.
It pretty much confirms that USA Does NOT have the v32 or v31. Mines currently on 30.2 i beleive.







IS IT ME OR DO YOU GUYS NOTICE THE SPELLING ERRORS HE MADE ON THE INVOICE.....

All of this conflicting info is very frustrating. The dealers all seem to be in a fog but they keep sticking that f***ing 1 to 5 service rating thing in my face every time I bring my car in.

Seems like some generally sad news all around today. I'm sure we'll learn and confirm more in the next two weeks.

Back to resting my lasik'd eyes for me. two hours past surgery and they feel like the sahara was dumped in them....but I can see stuff, which is cool. lol

I just took another quick drive...As you can see from my paperwork posted above, it says they updated me to 31.

I can definately confirm my car is STILL LAGGY AS HELL. The car seems EXACTLY the same as it was on 29.2

FWIW, the tech left his notes in the car where he wrote down all my radio presets.

I'm really confused...it seems to me that 31 is not our fix.

Yea thats true.


What was it in Pavel's case? I heard he DID get his DME updated.

Only time will tell what is going on..

I gave up calling the dealers.. Ill wait till someone confirms.

I am afraid that BMW NA is making things worse (for themselves especially) with all the shenanigans and stories how s/w works per design and how there are no issues with our vehicles - as if our main complaint is that s/w does not work per design.

We are probably all here in agreement that s/w does work per design, but that is really not our complaint, is it? The issue is that BMW has arbitrarily decided to alter the performance of our vehicles (by introducing the lag) most likely in order to save money on warranty claims. Why else would they not come out clean about the lag issue, especially after receiving complaints from customers all over the world? The answer, as stated in one of the previous posts, is that they simply cannot admit there is a problem with the lag because that would warrant the fix - the fix that costs money to develop, test and install; not to mention the negative publicity if they were to admit the screw up and even worse, the cover up.

BMW dealerships are not helping the situation either. Their SAs, SMs and shop foremen are either being told by BMW NA to lie to customers or they are totally oblivious to our gripes and not genuinely interested in helping us to resolve the issue.

Judging by the few posts here, which completely introduce confusion about what was really installed on the vehicles (“latest” s/w vs. v31 vs. v31 without DME update …) and what were the owners told was installed, I am prone to believe that BMW, BMW NA and some BMW dealerships are in cahoots on this issue and will do anything to avoid admitting that the problem with the turbo lag exists or that v31 fixes the same.

The bottom line is that we - the future plaintiffs - need to maintain our focus and share whatever reliable information we have and not let the lies served to us by the BMW NA reps and dealerships change direction of this thread or even worse - make it disappear. Nothing would make BMW NA's job easier on this matter than if we stopped openly sharing useful information.

Like a lot of others here, I'm disgusted that my car was possibly de-tuned by the manufacturer simply to reduce their warranty costs caused by design flaws.

But, for me, suing BMW over this lag issue would not be worth the hassle...just my personal opinion. I respect everyone's right to make their own decision and I dont care one way or the other what other people decide to do.

And, I dont get the feeling that anyone here is trying to make this thread disappear. I dont think the thread is going anywhere until BMW comes up with a fix.

If you do record calls, get their permission FIRST and then AGAIN on the recording. Otherwise, you could find yourself in very hot water....

Check the laws in your state, but there are quite a few states that only require one party to consent to a phone call being recorded. If that is the law in your state then you could be the one consenting party and still legally record it. A little loophole i found while dealing with some erroneous credit report info and the company that would not remove it.

As for suing BMW, I am working on it with a few lawyers. They intend to make it a nationwide class action which I am pretty sure would not require much work on the part of anyone who want to be included. That is something I will ask about on Thursday.

Does anyone live within a couple hours of Little Rock? I will pay your gas if you bring your car to the meeting on Thursday. Need a car with lag so the lawyers can expereience it first hand. If anyone knows anyone who might be a friend of your relatives third uncle 4 times removed's greaqt aunt that you met once when your were 3 and you remember her smelling like medicine and she kind of creeped you out a bit that has a car with lag, and they are relatively close to Little Rock, please contact them or have them PM me.

Oh yeah, totally unrelated but, I painted the garage today. What do you think? It matches my toolbox

I can tell ya V31 is not here yet! Im a SA and a BMW owner 335XI, so When V31 comes out Ill have it installed for sure...

What the changes are I dont know yet but Ill keep close contact with my Techs (as I do every day) and find out for sure!

basically, the below (from BMW marketing material/website) was true before my car was updated with new software. my original E89x-07-09-520 software (whatever version that was) had zero lag. since last week's update, lag.

bmw is a huge company, i'm sure a consumer advocate lawyer will be willing to take up a false advertising case since we have the plenty of proof. time to make some phone calls.

Yeah, I know. But, thanks for clarifying that for us.

The invoice also says car was updated to 31. SA and foreman said 31 does not include a DME update. I'm no expert...but the way I see it there are 2 possibilities:

1) DME is just one of the modules that can be updated with progman. 31 is a version that does NOT include a DME update (I think this is the case, see mistermojo's post above)...or...

2) SA's notes on my invoice about my car being updated to 31 are b/s and my car was NOT updated to 31, but rather to 30.2 or whatever

could be that US v31 has differnet emissions to europe and DME part won't be ready for the US until V31 - pure conjecture. edit - I meant v32

I'm going to call the dealership on Monday and get some more info. The foreman was not available when I picked up my car late on Friday.
