I don't think the OP needs to be "silenced." I'm sure we all agree that we'd never buy a BMW or any car for that matter from a Penske dealership, and by now we've told everyone we know using social networking to tell everyone else to bypass Penske from consideration. Would be hilarious if the car club put out an official statement not to buy from Penske.

Typically the best way to resolve these issues quickly is by keeping them nonpublic. Once you go public the process becomes more formal and drawn out.

I had a bankruptcy case once where the creditor repossessed a vehicle (which they had every right to do because the debtor missed payments) with special equipment installed for the couple's severely disabled child. The creditor's law firm was no help, so I told debtors the only choice was to go to the press. They did, and there was a story in the local paper pretty soon. The creditor bought the vehicle back (they has auctioned it as fast as they could) and GAVE the vehicle back to the debtors. A story did come out after that in the same paper about what that creditor had done giving a vehicle to a family with a severly disabled child.

dunno guys,

imo the OP did the right thing.

If i understand what your saying... work with the dealership to resolve the issue... the OP did work with the dealership and they jerked him off. The dealership refused to service his car on numerous attempts.

So the OP must do one or more of the following...
1 take car to another dealer to pull codes and repair.
2. contact a lawyer to get legally binding service agreement upheld by dealer and BMW ?

the dealership has already been provided enough time to fix the problem and they refused , trying to be "quiet" isnt going to yield any results... though posting on the forums will voice his displeasure with the treatment he receieved and also perk up BMWs ears.

BMWNA will come through, they did for me. Mine dealt with the ticking noise and cylinder head replacement. At first dealer did not want to do it because vehicle was out of warranty but BMWNA goodwill the repairs.

you almost got killed. this dealership knows this. id say go all the way out. to me them asking you to take down post is like violation of constitutional rights. hope you get everything you need done to your car by this dealer.

Too many people are afraid to "get involved". The OP's fight could end up saving lives.

BMW needs to hear about this stuff so they can investigate the technical problem and the dealership. These forums are probably the best way for them to get raw feedback from enthusiasts. Even though we are a small percentage of owners, we are vocal and that's the way it should be!

It's sad that BMW, as a brand, still suffers from the bad reputation that is caused by crappy/shady dealers (and there is a LOT of them). This reminds me of refusing to service control arms on my e46 back in early 2000s, had to complain on forums, call BMW NA, get letters from lawyers to fix a common problem that they claimed was 'normal'.

Still can't believe they pull shit like this. I think going public with these problems - hopefully you will get this resolved.

Thanks for posting this additional information arguru. As the owner of a professional services firm, I have to deal with HR issues at times, unfortunately. If what you posted above is true, termination for cause would be the least of Dumbrowski's concerns. BMWNA - your move.

Keep fighting the good fight Sir. This should not only serve as a wonderful wake up call to Penske, but hopefully other dealers who would dare to minimize owner concerns which could have catastrophic safety consequences.

Hmm, what's interesting is there are two problems. The first is the SAFETY issue with arguru's car. And I could see BMWNA trying to make that confidential. I'm very curious to know if the issue is related to the active steering or not, is it related to the warnings (as they aren't clear to be related to the steering), and then what failed and seemingly only once as I think arguru still drives the car (please verify arguru).

The second problem is Penske, and specifically the GM of the dealership. The second part is a customer relations issue and should be splattered across the Internet forever, and I really hope that dealership loses tons of sales in the years to come. TONS!
