The real cost of cat-less downpipes...

So I was actually giving google a good work out to see what the real truth is behind the $10k EPA fine myth...

Quote:
S. 43A(1) amended by Nos 20/1988 ss 12(a), 14(a), 49/2000 s. 3(5).

(1) A person who is the registered owner of a motor vehicle, the owner of an unregistered motor vehicle or the driver of a motor vehicle which is used on a highway and at the time of use—

S. 43A(1)(a) amended by No. 127/1986 s. 102(Sch. 4 item 8.2).

(a) is not equipped with any device or equipment required by the regulations to be fitted to the motor vehicle so as to prevent or minimize pollution; or

(b) is capable of emitting into the atmosphere any matter that does not comply with any prescribed—

(i) emission standard; or

(ii) standard of maximum permissible concentration—

for emissions—

shall be guilty of an offence.

Penalty: 60 penalty units.
And a current penalty unit is:
Quote:
Penalty units
Penalty units are used to define the amount payable for fines for many offences. For example, the fine for selling a tobacco product to a person aged under 18 is four penalty units.

One penalty unit is currently $147.61 from 1 July 2014 to 30 June 2015.

The rate for penalty units is indexed each financial year so that it is raised in line with inflation. Any change to the value of a penalty unit will happen on 1 July each year.
$147.61 * 60 units = $8,856.60

On that note, I am sure that outrunning the cops would have to be a lesser fine...

So... if they pull you over and tell you they're going to stick a sniffer up your pipes, maybe just stomp it and peel outta there!

If you have BOV does mean you get double the fine??

Catless downpipes does not = catless exhaust, which is where the fine comes into effect. N54's still have 2 cats further back

Nope, you still get fined if you remove either primary or secondary cats.

Let me find the link...

Edit:

Quote:
6.2 Exhaust Systems
The following applies instead of Section 2.7 of VSB 14 Modification Code LA. Modified and alternative exhaust systems are permitted if they satisfy the following requirements:
  • the exhaust system must not allow direct entry of exhaust gases into the occupant compartment
  • for vehicles fitted with one or more catalytic converters as original equipment, the catalytic converter(s) must be retained in their original location and all exhaust gas must flow through the converters at all times. Similarly any sensors positioned in the exhaust system as original equipment must be retained in their original locations

Innocent until proven guilty..

Most cops would have NFI about catless downpipes, if its too loud they slap you with a canary and you have to go to the EPA for emissions testing. Most owners then have their stock stuff re-installed and then go for emissions, pass then re-install the catless/aftermarket exhaust.

This is what I thought too, but reading other forums they apparently have the "power" to escort you to a mobile EPA station if they're out doing an operation on unroadworthy cars.

I can't find any evidence on these though - apparently they setup like a booze bus and the EPA guys are ready with their mobile equipment.

Seems like a lot of effort to me, but hey if their fine is $8k, I guess they don't fuck around.

But again.. this part is the bit I can't find any evidence of.

Yes that is indeed true, but in my experience these mobile EPA stations are always setup in the cruise hot spot zones on a fri/sat night or outside locations such as summernats...

I've always avoided such locations at these times (where generally all the yobbos/d1ckheads congregate) so I've never had an issue, and my mate who had a pretty crazy (fully catless) R34 GTR never did either over the years.

Even still the EPA officer would be doing well to spot the catless downpipe, if you failed emissions they would most likely slap a canary on the car and explain to you the car failed emissions and you need to have the aftermarket exhaust and tune on the car modified to meet emissions (I've had mates who have had such incidents occur and the EPA guys are generally pretty good and are quite helpful)

This is one of the reasons why I haven't yet installed catless DP's. I really want them baaad but the fine is huge if you get caught and secondly, those of you that have them installed have technically voided your insurance as most insurance contracts state that your vehicle has to be in a road-worthy condition at all times.

I hear this ~$10k fine for failed emission a lot on different car forums, but does anyone knows of anyone who actually got stung by it?

Also the likelyhood of getting done is pretty slim here in WA, seeing how I have never seen police here do 'biltzs' that focuses on nothing but modified/loud cars (unlike the East, where I frequently see news reports of VIC/NSW police go on special blitzs that targets the so called 'hoon' cars a.k.a mainly Jap imports) or any so called mobile emission testing stations (do they even exist here?)

All I've seen are the usual police booze buses and hiding reveune *opps I meant 'safety/speed'* cameras in buses.

I have catless DPs on my car and I get no attention from the police vs my old Skyline, where I used to get pulled over for 'random' license checks alot back when I was on my Ps.

When i use to have a skyline, use to get hassled and starred down by police till the point where there eyeballs on the side of their eye sockets wen passing by tryna still stare me down about to pop out.

im catless dp / muffler delete + lowered e92 but they never seem to even care. yet.
or they just dont know anything. I bet you they wouldnt even no much about bmw's e90/e92 exhaust system and the cats in the downpipes. lol

JB4 is illegal, dual cone filters are illegal, stretched tyres are illegal, hub spacers are illegal, coil over suspension is illegal...

Hell I bet even paint wrap and plasti-dip are illegal since it's changing the colour of your car.

IMHO if someone is so worried over things being illegal on their car, leave it stock and enjoy the car as it came from the factory. don't be a pussy like Nate said hahahaha

If you don't have DPs you are going slow. Being slow isn't worth it.
