Have they done anything with your car since you had it towed there? Have you called BMWNA? If so, what did they say? Can you take your car to another BMW dealership and have the codes read? The codes do not lie and should be able to tell, without a doubt, whether you had a state inspection error or if it was the DTC/DSC error.
The removal of posts is not an unusual request, but typically only seen when lawyesr are involved. I'm not one to ever suggest a lawyer, but I hope you have kept documentation of everything...

It seems to me that they are trying to scare you by using their lawyer = that would mean to me that they are responsible.
Call around for the free consultation with few lawyers in your area, see what they say. Call BMWNA if you have not done so. |

What a bunch of crooks. I read your original post and I recall your car is covered by the warranty. BMW NA covers all warranty work so why don't they do it? Call the BBB and report this dealership and other consumer groups. Email the President of BMW NA too and all the other ups. Make this public. It is pitiful that BMW and it's dealerships (sorry to all the ones that do, you do exist) do not stand behind their products.

Call media, call BMWNA, and get your car fixed at another dealer.
If it turns out to something major, you have the emails from the original dealer stating it was nothing. The last thing this dealer wants is bad publicity. Get your story all over the media and spread it around as many forums as you can. Hopefully http://jalopnik.com/ picks it up and blows this out of the water.

They will do everything they can to save their ass; even if they are wrong... I had a CPO issue as well once with another manufacturer. Trust me when I tell you; bad publicity and media fixes everything... send this story to jalopnik.

Who own's that dealership? PENSKE? I know I'd never buy a car from them, and neither would anybody I know. And probably be a good idea to spread the word. Those guys still refuse to sell BMW extended warranties, instead, selling an aftermarket brand? What'd PENSKE do again, overlook a serious issue on the OP's car? Better keep spreading the word. What do they call it? Going viral? About PENSKE?

they are requesting you to remove the posts on forums?
What authority are they basing on to require you to do that? What I can think of is defamation, but since that doesn't seem to be the case, and they continue to refuse service for your car I think you can ignore this request. Now back to the main point, based on what you said and the observations from other members, it's most probable that it was due to their negligence that you almost got yourself killed. I'd say I agree with some of the comments above, contact media, BMWNA, and as a last resort a lawyer. But I wouldn't go down the lawyer route until BMWNA refuses to do anything. I would additionally request for this dealership to be closed down. |

Wow, so I guess they are pretty aware of the site. When I googled the GMs name last week, your original post came up on the 2nd page. I have a feeling it's a tad higher now! In my opinion, having a lawyer contact you at this point is strange. Nothing you stated was really defamatory, just a bit emotional, as could be expected.
Here are the facts though. Your images are of a warning light in your car, that's documented by your owner's manual. After being "mis-diagnosed" by the service tech, you were sent on your way. Days later, you actually are involved in a MAJOR SAFETY FAILURE in your car. Let me repeat, MAJOR SAFETY FAILURE! This is an extremely serious issue. And in my opinion, actually goes beyond the dealership, and I would contact BMW NA immediately to voice your concerns just with the safety of your vehicle. This is NOT a convenience issue, it's a safety issue, I want to stress this. The fact that the dealership is not taking the opportunity to "re-diagnose" your vehicle at this point under warranty is also strange. Penske personnel, if you're reading this, I think if you just fix the issue, the OP would state you fixed it, you'd help diagnose a possible safety failure in the vehicle, and this would be over. That your dealership keeps up this mentality is only going to continue to bring negativity around your organization. These types of threads always find their ways to other car sites as well. You're fanning flames, that strategy almost never seems to work. OP, definitely hold fast, keep your lawyer on speed dial, and I'd continue to attempt to work with the lawyer that called you. The GM obviously is not interested in helping you, but maybe you can work something out with this lawyer. I'd call him everyday to see if there is any further resolution. And after enough days go by, and no action has occurred, I'd ask him directly, if you were me, what would you do? Remind him that this is seemingly a major safety critical failure. I develop medical devices for a living. We work very hard to make sure they are safe. We go through many aspects of a device to ensure that any risks to a patient are mitigated. The car industry I'd imagine goes through the same level (and probably more) making sure these vehicles have their potential hazards mitigated to a reasonable level. That a car could lose it's steering "completely" at highway speeds is such a severe hazard, I'm sure the engineers worked very hard to ensure what happened to you wouldn't. But it did, so this needs to be understood how it could happen. Is it an engineering problem? A failed part? Bad software or electronics? That a dealer is ignoring you and saying the warning you got was a state inspection is completely nauseating. |

While you're taking care of the other issues, file a complaint with the NHTSA against BMW NA for the actual occurrence on the highway.
National Highway Transportation Safety Administration - File a Safety Complaint ( http://www-odi.nhtsa.dot.gov/ivoq/ ) You and/or others on the roadway could have been seriously injured. Regards D.
